About measures for enhancement of use of national network segment Internet

For the purpose of ensuring protection of interests of the personality, society and the state in the information sphere, creations of conditions for further development of national segment of global computer network the Internet, improvement of quality and availability of information on activities of state bodies, other organizations and Internet services provided to citizens and legal entities:

1. Determine that:

1.1. republican state bodies, local executive and administrative organs, other state bodies and the state organizations, and also economic societies concerning which the Republic of Belarus or administrative and territorial unit, having shares (shares in authorized funds), can determine the decisions made by these economic societies (if other is not determined, further – state bodies and the organizations) shall place information on the activities in global computer network the Internet (further – the Internet) on the official sites of these state bodies and organizations or on the corresponding pages of the official sites of higher state bodies and organizations (further – the websites);

1.2. state bodies and the organizations provide creation, functioning and systematic updating of the websites with use of information networks, systems and resources * national network segment the Internet **, placed in the territory of the Republic of Belarus and registered taking into account requirements of Item 3 of this Decree;

1.3. the websites of state bodies and organizations are created in the Russian and (or) Belarusian languages, and if necessary also in one or several foreign languages. The state organizations performing export of products out of limits of the Republic of Belarus in addition provide forming of the language version of the websites in one or several foreign languages;

1.4. homepages of the websites of state bodies and organizations shall directly or in the form of separate headings to contain general information about state body and the organization (about management, structure, operation mode, tasks and functions, the postal address, the e-mail address, phone numbers of service desks of this body (organization), territorial subdivisions, etc.), about work with addresses of citizens and legal entities, about implementation of ministerial procedures concerning citizens, legal entities and individual entrepreneurs, about the goods (works, services) made (which are carried out, rendered) the state organization, and also other information determined by the President of the Republic of Belarus or Council of Ministers of the Republic of Belarus or placed according to the decision of the head of state body and organization;

1.5. information is not subject to placement on the websites of state bodies and organizations, distribution and (or) provision of which is limited or it is forbidden according to legal acts;

1.6. the information access, posted on the websites of state bodies and organizations according to requirements of subitem 1.4 of this Item, is free. State bodies and the organizations have no right to levy payment for access to this information;

1.7. state bodies and the organizations shall carry out regularly the analysis of attendance of their websites and take measures for implementation of proposals of the citizens directed to enhancement of functioning of these websites.

Requirements to content of the websites of state bodies and organizations, and also procedure for their functioning are determined by Council of Ministers of the Republic of Belarus in coordination with Administration of the President of the Republic of Belarus.

* For the purposes of this Decree the terms "information networks", "information systems" and "information resources" are used in the value determined by article 1 of the Law of the Republic of Belarus of November 10, 2008 "About information, informatization and information protection" (The national register of legal acts of the Republic of Belarus, 2008, No. 279, 2/1552).

** For the purposes of this Decree the Internet is understood as national network segment set of the information networks, systems and resources having connection to the Internet, placed in the territory of the Republic of Belarus and (or) using domain names in national domain zone which is formed by domain zones ".by" and ".bet".

2. Since July 1, 2010 the sales activity of goods, to performance of works, rendering services in the territory of the Republic of Belarus with use of the information networks, systems and resources having connection to the Internet is performed by the legal entities, their branches and representations created according to the legislation of the Republic of Belarus with the location in the Republic of Belarus, and also the individual entrepreneurs registered in the Republic of Belarus (further - legal entities and individual entrepreneurs), with use of the information networks, systems and resources of national network segment the Internet placed in the territory of the Republic of Belarus and registered in accordance with the established procedure.

3. State registration of the information networks, systems and resources of national network segment the Internet placed in the territory of the Republic of Belarus is performed by the declarative principle by the organization authorized by the Ministry of Communications and Informatization based on the corresponding address of suppliers Internet uslug*.

The list and document forms, represented by suppliers of Internet services ** for state registration of the information networks, systems and resources of national network segment the Internet placed in the territory of the Republic of Belarus, procedure for their state registration are determined by Council of Ministers of the Republic of Belarus in coordination with Operational analytical center in case of the President of the Republic of Belarus.

* For the purposes of this Decree Internet services are understood as services in ensuring access of legal entities and physical persons, including individual entrepreneurs, to the Internet and (or) placement in this network of information, to its transfer, storage, modification.

** For the purposes of this Decree the supplier of Internet services is understood as the legal entity or the individual entrepreneur rendering Internet services in the territory of the Republic of Belarus.

Legal entities and individual entrepreneurs shall provide till July 1, 2010 transition to use of the information networks, systems and resources of national network segment the Internet placed in the territory of the Republic of Belarus, and suppliers of Internet services – their state registration.
