About approval of conditions of distribution of foreign and multilateral permissions to the Russian carriers

In pursuance of Item 8 of Rules of issue of the Russian permissions to foreign carriers, and also foreign and multilateral permissions to the Russian carriers approved by the order of the Government of the Russian Federation of February 16, 2008 N 89 (The Russian Federation Code, 2008, N 8, to the Art. 745), I order:

Conditions of distribution of foreign permissions to the Russian carriers (appendix N 1 to this order);

Conditions of distribution of multilateral permissions to the Russian carriers (appendix N 2 to this order).

Conditions of distribution of foreign permissions to the Russian carriers

1. Conditions of distribution of foreign permissions to the Russian carriers (further - Conditions) are developed according to Item 8 of Rules of issue of the Russian permissions to foreign carriers, and also the foreign and multilateral permissions to the Russian carriers approved by the order of the Government of the Russian Federation of February 16, 2008 N 89 * and are applied if the quantity received by the Ministry of Transport of the Russian Federation from competent authorities of foreign states of foreign permissions (further - foreign permissions) is less than total annual requirement of the Russian carriers.

2. Starting base for forming of distribution of foreign permissions (further - distribution) is the declared annual requirement of carriers for the specified permissions with quarterly breakdown, and also quantity received by the Ministry of Transport of the Russian Federation from competent authorities of foreign states of foreign permissions on categories of the environmental and technical standards of safety established by the European conference of Ministers of Transport, and types of foreign permissions, divided on quarters is pro rata to quarterly breakdown of the declared annual requirement of carriers.

Distribution by each type of foreign permissions over the countries is performed quarterly on categories of environmental and technical standards of safety in proportion to share of the declared quarter requirement of each carrier for the part of total annual requirement falling on the respective quarter taking into account the additional terms specified in Item of 3 these Conditions.

If as a part of the total quantity of permissions received from competent authority of foreign state, part of foreign permissions of one type provides use of mixed traffic (further - foreign permissions of mixed traffic), the share of foreign permissions of mixed traffic in total quantity of foreign permissions of this type as the relation of quantity of foreign permissions of mixed traffic to total quantity of foreign permissions of this type is determined (further - the equity relation). Distribution of foreign permissions of this type to carriers is performed according to the equity relation.

3. In case of distribution the following conditions are established:

1) availability of timely provided request for determination of total annual requirement in foreign permissions in the form approved by the order of the Ministry of Transport of the Russian Federation of July 17, 2008 N 110 "About implementation of the order of the Government of the Russian Federation of February 16, 2008 N 89" ***;

2) availability at carrier of the vehicles corresponding on environmental and technical standards of safety of category of the foreign permissions which are subject to distribution;

3) making by carrier during the period from January 01 to December 31 the year preceding carrying out distribution (further - the previous accounting period), one or more trips based on foreign permissions (further - work experience).

If the carrier in the previous accounting period had work experience, the coefficient of work experience is equal 1, if the work experience was not available, the coefficient of work experience is equal to 0,5;

4) lack of violations in case of accomplishment of the international motor transportations during the previous accounting period.

In case of absence at carrier in the previous accounting period of violations of procedure of the international motor transportations, the coefficient of accounting of violations is equal 1, if the carrier had violations during the previous accounting period, then the coefficient of accounting of violations is equal to 0,5;

5) use of foreign permissions for implementation of carriages of goods in (from) the country from which competent authority the specified permissions are got (further - use of foreign permissions on the direction), in the previous accounting period.

If the carrier used the distributed foreign permissions in the previous accounting period and the quantity of such permissions requested by it no more than for 10% exceeds the quantity of the foreign permissions used by it on this direction in the previous accounting period, the utilization rate of the distributed foreign permissions is equal to 1.

If the carrier used the distributed foreign permissions in the previous accounting period and the quantity of such permissions requested by it more than for 10% exceeds the quantity of the foreign permissions used by it on this direction in the previous accounting period, the utilization rate of the distributed foreign permissions is calculated as the relation of the quantity of such permissions used in the previous accounting period increased by 10% to quantity of required.

If the carrier did not use the distributed foreign permissions in the previous accounting period on this direction, the utilization rate of the distributed foreign permissions is equal to 0,5.

6) use of foreign permissions of mixed traffic for carriages of goods in/from the country from which competent authority permissions, in the previous accounting period are got.

If in the previous accounting period the carrier used foreign permissions of mixed traffic with observance of the equity relation, the utilization rate of foreign permissions of mixed traffic is equal to 1,5.

If in the previous accounting period the carrier used one or more foreign permissions of mixed traffic, but it is lower than the level of the equity relation, the utilization rate of foreign permissions of mixed traffic is equal to 1.

If in the previous accounting period the carrier did not use foreign permissions of mixed traffic, the utilization rate of foreign permissions of mixed traffic is equal to 0,5.
