Approve the enclosed Rules of inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name.

Rules of inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also words derivative of this name

1. These rules establish procedure for inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name.

2. Permission to inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name is issued by the Ministry of Justice of the Russian Federation if the legal entity has branches and (or) representations in the territory more than half of subjects of the Russian Federation, or the legal entity is in accordance with the legislation of the Russian Federation carried to the largest taxpayer and also if more than 25 percent of voting shares of joint-stock company or more than 25 percent of the authorized capital of other economic society are in property of the Russian Federation or the organization created by the Russian Federation based on the special Federal Law which name includes the official name "Russian Federation" or "Russia", and also the words derivative of this name regarding use in trade name of the specified legal entity of the name of this organization, being his participant.

3. The sole executive body of the legal entity (further - the applicant) submits the following documents to the Ministry of Justice of the Russian Federation:

a) the statement for intention to include in the trade name the official name "Russian Federation" or "Russia", and also the words derivative of this name;

b) copies of constituent documents of the legal entity with presentation of originals in case of lack of notarized copies;

c) decision of founders (participants, shareholders) on the appeal to the Ministry of Justice of the Russian Federation on inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also words derivative of this name;

d) documents on compliance of the legal entity to one of requirements, stipulated in Item 2 these rules, in particular:

the copy of the notification on registration in tax authority of the legal entity as the largest taxpayer;

the paragraph third ceased to be valid according to the Order of the Government of the Russian Federation of 25.09.2017 No. 1157

the statement from the shareholder register of joint-stock company.

4. For the purpose of confirmation of information on compliance of the legal entity to requirements, stipulated in Item 2 these rules, the Ministry of Justice of the Russian Federation requests necessary data from state bodies and the organizations.

State bodies and the organizations provide to the Ministry of Justice of the Russian Federation the required information within 10 working days from receipt date of request.

5. The Ministry of Justice of the Russian Federation publishes the order about inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name, no later than 30 days from the date of receipt of documents, stipulated in Item 3 these rules.

In case of detection of discrepancy of the applicant to requirements, stipulated in Item 2 these rules, the Ministry of Justice of the Russian Federation directs to the applicant motivated refusal about inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name, in the specified term.

6. Modification of constituent documents of the legal entity in connection with inclusion in trade name of the official name "Russian Federation" or "Russia", and also the words derivative of this name, is allowed only after the edition of the order of the Ministry of Justice of the Russian Federation, stipulated in Item 5 these rules.

7. In the presence at the Ministry of Justice of the Russian Federation of data on the discrepancy of the legal entity to requirements, stipulated in Item 2 these rules making impossible further use in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name, the Ministry of Justice of the Russian Federation publishes the order about withdrawal of earlier issued permission to use of such name.

8. In case of withdrawal of permission to inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name, the legal entity shall bring within 3 months from the date of the edition of the order, stipulated in Item 7 these rules, corresponding changes in the constituent documents.

9. In case of withdrawal of permission to inclusion in trade name of the legal entity of the official name "Russian Federation" or "Russia", and also the words derivative of this name, the Ministry of Justice of the Russian Federation within 10 days from the date of the edition of the order, stipulated in Item 7 these rules, sends its copy to the authorized federal executive body performing state registration of legal entities and the legal entity concerning whom such order is accepted.

10. In case of change of trade name of the legal entity or its form of business the legal entity reserves the right to use in the trade name of the official name "Russian Federation" or "Russia", and also the words derivative of this name received based on the permission issued in accordance with the established procedure. The permissions issued according to the procedure, acting before entry into force of these rules, keep the action.
