About approval of Rules of provision of the housing help

1. Approve the enclosed Rules of provision of the housing help.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of provision of the housing help

These rules of provision of the housing help (dalee-Pravila) are developed according to the Law of the Republic of Kazakhstan of April 16, 1997 "About the housing relations" and determine procedure for purpose of the housing help to needy families (citizens).

Chapter 1. General provisions

1. In Rules the basic concepts are used:

1) share of maximum-permissible expenses – the relation of the maximum-permissible expense level of needy family (citizen) in month on management of object of condominium and content of common property of object of condominium, including on capital repairs of common property of object of condominium, consumption of utilities and communication services regarding increase in subscriber fee for phone connected to network of telecommunications, use of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock to comprehensive income of needy family (citizen) as a percentage;

2) comprehensive income of needy family (citizen) – the total amount of the income of family (citizen) in the quarter preceding quarter of the request for purpose of the housing help;

3) it is excluded

4) authorized body - the executive body of the city of republican value, the capital, area (city of regional value) financed by means of the local budget, performing purpose of the housing help;

5) it is excluded

6) needy families (citizens) - persons who according to the housing legislation of the Republic of Kazakhstan have the right to the housing help;

7) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services, services in issue of specifications on connection to networks of subjects of natural monopolies and services of subjects of the quasi-public sector according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services, services in issue of specifications on the connection to networks of subjects of natural monopolies, services of subjects of the quasi-public sector and issue of their results to uslugopoluchatel by the principle of "one window", and also ensuring rendering the state services electronically performing state registration of the rights to real estate in the place of its stay.

2. The housing help is provided at the expense of means of the local budget to needy families (citizens) who are constantly registered and living in the dwelling which is on the property right as the single dwelling in the territory of the Republic of Kazakhstan, and also to employers (subtenants) of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock on payment:

expenses on management of object of condominium and content of common property of object of condominium, including capital repairs of common property of object of condominium;

consumption of utilities and communication services regarding increase in subscriber fee for phone connected to network of telecommunications;

expenses for use of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock.

The expenses of needy families (citizens) accepted to calculation of the housing help are determined as expense amount by each of the above-stated directions.

The housing help is determined as difference between payment amount of expenses on management of object of condominium and content of common property of object of condominium, including capital repairs of common property of object of condominium, consumption of utilities and communication services regarding increase in subscriber fee for phone connected to network of telecommunications, use of the dwelling from the state housing stock and the dwelling leased by local executive body in private housing stock and the maximum permissible expense level of needy families (citizens) on these purposes established by local representative bodies, no more than 10 percent.

3. Housing help is given on the accounts shown by suppliers about monthly fees on management of object of condominium and content of common property of object of condominium, including capital repairs of common property of object of condominium according to expense budget and invoices for payment of utilities at the expense of budgetary funds to needy families (citizens). The size and procedure for rendering the housing help are determined by local representative bodies of the cities of republican value, the capital, areas, cities of regional value.

3-1. The needy family (citizen) (or his representative under the notarized power of attorney) has the right to address to the State corporation or on the web portal of "the electronic government" behind purpose of the housing help once in quarter.

3-2. The term of consideration of documents and decision making about provision of the housing help or the motivated answer about refusal from the date of acceptance of complete set of documents of the State corporation or through the web portal of "the electronic government" constitutes eight working days.

Chapter 2. Procedure for purpose of the housing help

4. For purpose of the housing help the needy family (citizen) (or his representative under the notarized power of attorney) addresses to the State corporation and/or by means of the web portal of "the electronic government" with provision of the following documents:

1) the identity document of the applicant (the original is submitted for identification of the personality);

2) the document confirming the income of needy family. The procedure for calculation of comprehensive income of family (the citizen of the Republic of Kazakhstan) applying for receipt of the housing help is determined by authorized body in the sphere of the housing relations;
