About approval of Rules of establishment of requirements of energy efficiency of goods, works, services when implementing purchases for ensuring the state and municipal needs

According to article 26 of the Federal law "About Energy Saving and about Increase in Energy Efficiency and about Modification of Separate Legal Acts of the Russian Federation" Government of the Russian Federation decides:

1. Approve the enclosed Rules of establishment of requirements of energy efficiency of goods, works, services when implementing purchases for ensuring the state and municipal needs (further - Rules).

2. To the Ministry of Economic Development of the Russian Federation in coordination with the Ministry of Industry and Trade of the Russian Federation, the Ministry of Energy of the Russian Federation and Federal Antimonopoly Service to establish requirements of energy efficiency in the relation:

the goods provided by appendix to Rules - till July 1, 2011;

the goods specified in the subitem "b" of Item 3 of Rules - no later than 2 months from the date of approval by authorized federal executive body of classes of energy efficiency for such goods;

the goods specified in the subitem "v" of Item 3 of Rules - till May 1, 2010;

works and services which procurement is conducted for the state or municipal needs, in the course of accomplishment which rendering considerable amounts of energy resources are spent, - till January 1, 2016.

3. To the Ministry of Economic Development of the Russian Federation annually, since 2018 to carry out the analysis:

a) energy efficiency of goods when implementing purchases for ensuring the state or municipal needs regarding identification of types of goods when which using energy resources in the amounts making essential share in structure of consumption of separate groups of the state or municipal customers performing similar types of activity are spent;

b) requirements of energy efficiency of goods, works, services when implementing purchases for ensuring the state or municipal needs established by the legislation of foreign states and possibility of their application in the Russian Federation.

4. To the Ministry of Industry and Trade of the Russian Federation together with the Ministry of Energy of the Russian Federation annually, no later than March 1 to bring in the Ministry of Economic Development of the Russian Federation of the offer on change existing and (or) to introduction of new requirements of energy efficiency of goods, works, services when implementing purchases for ensuring the state and municipal needs proceeding from need of increase in energy efficiency of such goods, works, services.

5. This resolution becomes effective from the date of its official publication, except for Item 7 of Rules.

The subitem "an" of Item 7 of Rules becomes effective after 90 days from approval date authorized federal executive body of classes of energy efficiency concerning the corresponding types (categories) of household energy-requiring devices.

The subitem "b" of Item 7 of Rules becomes effective since January 1, 2011.

Subitems "v" - "d" Item 7 of Rules become effective since March 1, 2010.

Rules of establishment of requirements of energy efficiency of goods, works, services when implementing purchases for ensuring the state and municipal needs

1. These rules determine procedure for establishment of requirements of energy efficiency of goods, works, services when implementing purchases for ensuring the state and municipal needs (further - requirements of energy efficiency), and also first-priority requirements of energy efficiency.

Requirements of energy efficiency are subject to application concerning goods, works, services when implementing purchases for ensuring the state and municipal needs, except for case of their incompatibility in case of interaction with the goods used by the state or municipal customer.

2. Requirements of energy efficiency are established by the Ministry of Economic Development of the Russian Federation.

3. Requirements of energy efficiency are subject to establishment concerning the following types of goods:

a) goods according to appendix;

b) goods concerning which the authorized federal executive body determines classes of energy efficiency, except for goods for which according to the subitem "an" of this Item requirements of energy efficiency, and goods specified in the subitem "an" of Item 7 of these rules are established;

c) the goods used for creation of elements of structures of buildings, structures, constructions, including the engineering systems of resource provisioning influencing energy efficiency of buildings, structures, constructions.

4. Requirements of energy efficiency are subject to establishment concerning works, services in designing, construction, reconstruction and capital repairs of capital construction projects which procurement is conducted for ensuring the state and municipal needs.

If result of performance of works for the state or municipal needs is production or conversion of goods concerning which requirements of energy efficiency are established, then such goods shall conform to the established requirements of energy efficiency.

If during the course of performance works for the state or municipal needs as material the goods concerning which requirements of energy efficiency are established are used, such goods shall conform to the established requirements of energy efficiency.

5. In the established requirements of energy efficiency types and types of goods, works, services to which they extend, date with which requirements become effective (but not earlier than 90 days from the date of their approval), and also one or several of the following indicators are specified:

a) values of class (classes) of energy efficiency of goods (in case of their availability);

b) the settlement (predicted) amounts of the used energy resources (depending on characteristics of goods, work, service);

c) measure values of energy efficiency of goods, works, services;

d) characteristics, parameters of goods, works, services influencing amount of the used energy resources.

5(1). Requirements of energy efficiency for the goods specified in appendix to these rules are established taking into account indicators of energy saving and increase in energy efficiency and their values, and also techniques (methods) of their measurement (testing) determined by documents by standardization. At the same time in requirements of energy efficiency of goods the reference to the relevant documents on standardization shall be contained.
