About the child's rights

This Law establishes the rights of the child, obligation of the state, relevant organs and citizens, and also program bases of implementation of state policy in the field of protection of the rights of the child and governs the related relations.

Chapter 1. General provisions

Article 1. Limits of operation of the Law

The state proceeds from first priority of the principles of training of the child for full-fledged life in society, developments in it public and creative activity, education of high moral qualities, patriotism and education of the citizen in it. The child is under protection and protection of the state and society.

Each person which did not reach 18 years is considered the child, except as specified, when in the procedure established by the law it acquires capacity to act or acknowledged capable earlier.

Article 2. Legislation on the child's rights

The child's rights in the Republic of Armenia are determined by the Constitution of the Republic of Armenia, international ratified by agreements of the Republic of Armenia, this Law and other regulatory legal acts of the Republic of Armenia. If international treaties of the Republic of Armenia establish other regulations, governing laws of the child, than those which are provided by this Law then are effective regulations of the international treaty.

Article 3. The bodies protecting the child's rights

Protection of the rights of the child is performed by authorized state body and local government bodies. The state cooperates with persons and public associations promoting protection of the rights of the child through relevant organs.

Article 4. Equality of children

Children have the equal rights, irrespective of nationality, race, floor, language, religion, social origin, property or other status, education, the residence of their and their parents or other legal representatives (adoptive parents, guardians or custodians), from circumstance of the birth, the state of health of the child or other circumstance.

Chapter 2. Basic rights of the child and their guarantee

Article 5. Child's right to life

Each child has the right to life.

The state and its relevant organs create necessary conditions for life and development of the child.

Article 6. The child's right addressed to and nationality

Each child from the moment of the birth has the right addressed to and nationality. The fact of the birth of the child in the procedure established by the Law is registered body of civil registration.

The child acquires nationality, his nationality stops according to the procedure, established by the Law of the Republic of Armenia "About citizenship of the Republic of Armenia".

Article 7. Child's right to health protection

Each child has the right to protection and strengthening of health.

The relevant state bodies provide the child with opportunity free or on favorable terms uses of health services within target monthly health programs.

Article 8. Child's right to necessary vital conditions

Each child has the right to the vital conditions necessary for full physical, intellectual and spiritual development.

In question of providing necessary vital conditions for development of the child the main responsibility is born by parents or other legal representatives.

In case of inability of pla of impossibility of providing with parents or other legal representatives of necessary vital conditions for the child the state gives appropriate assistance.

Article 9. Child's right to protection against violence

Each child has right of defense from any violence (physical, moral and another).

To any person, including parents or other legal representatives, it is forbidden to subject the child to violence or the punishment degrading its advantage or other similar relation.

In case of violation of the rights and legitimate interests of the child the violator bears responsibility according to the procedure, established by the legislation of the Republic of Armenia.

The state and its relevant organs perform protection of the child against any violence, operation, involvement in criminal activities, including against the use of drugs, involvement in their production or trade, begging, debauchery, gamblings and against other violation of its rights and legitimate interests.

Article 10. Child's right to freedom of thought, conscience and religion

Each child has right to liberty of thought, conscience and religion. Views, beliefs and judgments of the child are subject to due attention according to its age and maturity.

The right to liberty of religion and expression of views can be limited only under the law if it is necessary for protection of the state or public security, public order, health, moral shape of the child or basic rights and freedoms of other persons.

Each child has the right of free expression of the opinion, search, obtaining and transfer of the ideas and information by means of any communication medium. The child's right to receipt of information can be limited to the law.

Participation of the child up to 16 years in the religious organizations without the consent of the parent or other legal representative is forbidden.

Article 11. Child's right to education

Each child has the right to education and the choice of educational institution.

The relevant state bodies create necessary conditions for manifestation of identity of the child, development of his talent, mental and physical capacities, establishing comprehensive, vocational schools, the sports, technical and children's cultural and creative centers and others.

The relevant state bodies are developed and perform appropriate programs on identification of talented children, their education and the organization of education.

Secondary education in the state educational institutions is free. Each child has the right to free higher and other professional education on competitive basis in the state educational institutions.

The relevant state bodies provide availability of information and the materials necessary for education and professional training of the child.

Article 12. The child's right to accommodation in family

Each child has the right to recognition of parents and cohabitation with them, those cases except for established by the legislation of the Republic of Armenia when by a court decision the child's excommunication from parents or the parent is considered need proceeding from vital interests of the child.
