Regulations on service in migratory bodies

This Provision establishes procedure and conditions of service in migratory bodies of the Azerbaijan Republic, basis of legal status of workers of data of bodies.

Chapter I. General provisions

1. The service in migratory bodies is special type of public service of the citizens of the Azerbaijan Republic performing powers on stipulated by the legislation activities of the relevant organ of the executive authority which is a part of the system of law enforcement agencies of the Azerbaijan Republic.

2. Service by employees of migratory bodies is based on the principles of activities of migratory bodies, stipulated by the legislation the Azerbaijan Republic. In case of service employees of migratory bodies are guided by requirements of the law and perform the activities within the powers.

3. The legal basis of service in migratory bodies is constituted by the Constitution of the Azerbaijan Republic, the international agreements which participant is the Azerbaijan Republic, this Provision and other regulatory legal acts of the Azerbaijan Republic.

4. Acceptance on service in migratory bodies is regulated by this Provision and other legal acts of the Azerbaijan Republic taking into account provisions of the Law of the Azerbaijan Republic "About public service" including article 15-1 of the specified Law, the citizens concerning the right to be accepted on public service, implementation of acceptance on service on tender and based on transparency, assessment of activities of government employees and other principles of public service.

5. This Provision extends to the employees of relevant organ of the executive authority performing the powers established by the legislation of the Azerbaijan Republic and holding the positions providing special ranks.

5-1. For the purpose of regulation of the office relations between persons working in migratory bodies, and determinations of their qualification qualities in these bodies are established the special ranks and positions providing younger, average, senior and highest special ranks.

6. The questions of employment relationships which are not provided by this Provision and also service of persons occupied on the positions which are not providing special ranks are regulated by the relevant standards of the Law of the Azerbaijan Republic "About public service" and the Labor code of the Azerbaijan Republic.

Chapter II. Acceptance on service in migratory bodies, appointment of workers to position and dismissal

7. The citizens of the Azerbaijan Republic having the professional training meeting the requirements of the corresponding position, and who are fluent in state language of the Azerbaijan Republic have rights to serve in migratory bodies irrespective of their race, ethnic origin, religion, language, floor, social origin, property status, the residence, beliefs, belonging to labor unions or other public associations.

7-1. On service in migratory bodies on the positions providing averages and the senior special ranks only persons with the higher education, and on service on the positions providing younger special ranks - persons at least with complete average and secondary vocational education are accepted.
