About approval of Rules of provision of subsidies from the federal budget to legal entities on cost recovery on the treatment of radioactive waste

The government of the Russian Federation decides:

Approve the enclosed Rules of provision of subsidies from the federal budget to legal entities on cost recovery on the treatment of radioactive waste.

Rules of provision of subsidies from the federal budget to legal entities on cost recovery on the treatment of radioactive waste

1. These rules establish the purposes and conditions of provision of subsidies from the federal budget to legal entities on cost recovery on the treatment of radioactive waste (collection, sorting, conversion, conditioning, transportation, storage, burial of radioactive waste, including the fulfilled sources of ionizing radiation) (further - subsidies), and also selection criteria of the legal entities having the right to subsidies, and procedure for determination of the size of subsidies.

2. Provision of subsidies is performed within budgetary appropriations and limits of the budget obligations approved in accordance with the established procedure State Atomic Energy Corporation "Rosatom" on the purposes specified in Item 3 of these rules.

3. Subsidies are provided to legal entities of any form of business, except for the public (municipal) institutions (further - legal entities), on a grant basis for the purpose of cost recovery on accomplishment of one or several transaction types - collection, sorting, conversion, conditioning, transportation, storage, burial of the radioactive waste (including the fulfilled sources of ionizing radiation) which are arriving from federal state institutions and the federal state companies, and also storage and (or) burial of the radioactive waste (including the fulfilled sources of ionizing radiation) being at legal entities.

4. For decision making about provision of subsidy the legal entity applying for receipt of subsidy no later than February 5 represents the following documents to State Atomic Energy Corporation "Rosatom":

a) the request for provision of subsidy in the form approved by State Atomic Energy Corporation "Rosatom";

b) copies of documents on recognition by governing body of use of atomic energy provided by the order of the Government of the Russian Federation of July 3, 2006 N 412 "About the federal executive bodies and authorized organizations exercising public administration of use of atomic energy and state regulation of safety when using atomic energy" of the legal entity suitable to operate Items of storage of radioactive waste and to perform by own forces or with involvement of other organizations activities for placement, designing, construction, operation and conclusion from operation of Item of storage, and also activities for the treatment of radioactive materials;

c) copies of permissions (licenses):

on operation of the stationary object intended for storage of radioactive waste;

on the treatment of radioactive waste in case of their transportation;

on the treatment of radioactive waste in case of their conversion;

d) the copy of accounting records on the last reporting date with mark of tax authority;

e) the reference of tax authority confirming absence at the legal entity of unexecuted obligation on tax payment, charges, penalty fee and tax sanctions which are subject to payment in accordance with the legislation of the Russian Federation;

e) reasons for the size of subsidy;

g) the document confirming stay at the legal entity on the property right or on other legal cause of Items of storage of radioactive waste (the stationary objects intended for storage of radioactive waste) (in case of receipt of subsidy for cost recovery on storage or burial of radioactive waste).

5. In addition to the documents specified in item 4 of these rules, the State Atomic Energy Corporation "Rosatom" has the right to request other documents necessary for check of reliability of the data provided by legal entities from legal entities.

6. The State Atomic Energy Corporation "Rosatom" registers the documents submitted by legal entities according to item 4 of these rules, on first come and checks completeness and reliability of the data containing in them. In case of inadequate registration the specified documents in 10-day time from receipt date in State Atomic Energy Corporation "Rosatom" are subject to return with motivated refusal.

Legal entities have the right within 3 working days repeatedly to introduce properly processed documents.

7. The decision on provision of subsidy is made by State Atomic Energy Corporation "Rosatom" no later than the last working day of February.

8. The size of subsidy is calculated proceeding from expenses per unit of works (services), and also proceeding from the planned amounts of works (services) and is determined according to the methodical instructions approved by State Atomic Energy Corporation "Rosatom".

9. Subsidies are not provided to legal entities in the following cases:

a) submission of the documents specified in item 4 of the these rules containing false information;

b) receipt of means by the legal entity from the federal budget on the purposes specified in Item 3 of these rules on other bases;

c) discrepancy of planned activities (services) specified by the legal entity in case of reasons for the size of subsidy, to the purposes specified in Item 3 of these rules;

d) expiration of permissions (licenses) specified in item 4 of these rules during implementation by the legal entity of planned activities (services).

10. The subsidy is provided according to the agreement on provision of subsidy signed by State Atomic Energy Corporation "Rosatom" with the legal entity (further - the agreement). The agreement determines procedure, the purposes, terms and conditions of provision of subsidy, its size, procedure and terms of submission of the report on use of subsidy, and also procedure for return of subsidy in case of violation of the purposes and conditions determined by these rules and the agreement and the right of State Atomic Energy Corporation "Rosatom" to conducting checks of observance by legal entities of the conditions established by these rules.

11. Legal entities represent to State Atomic Energy Corporation "Rosatom" the report on use of subsidy on form and to terms which are established by State Atomic Energy Corporation "Rosatom".

12. Control of target use of subsidies is exercised by State Atomic Energy Corporation "Rosatom" and the federal executive body performing functions on control and supervision in the financial and budget sphere.
