ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of some veterinary sanitary standards about non-commercial movement of pets

(as amended on 02-07-2014)

For the purpose of health protection of animals, the prevention of transfer of diseases from animals to the person and according to provisions of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (The official monitor of the Republic of Moldova, 2008, Art. No. 51-54, 153), with subsequent changes and amendments, DECIDES: the Government

1. Approve:

Veterinary sanitary standard about conditions of health of animals of the pets applied in case of non-commercial movement according to appendix No. 1;

Veterinary sanitary standard about passport sample for pets of types: dogs, cats and domestic polecats according to appendix No. 2.

2. To the national agency on safety of foodstuff to develop:

Specific requirements and sample of the passport which shall accompany pets of the types provided in Items when importing to the territory of the Republic of Moldova and) - c) appendices No. 1 to the Veterinary sanitary standard establishing the conditions of health of animals applied in case of non-commercial movement of the pets intended for movement to other countries;

Technical requirements on identification of pets of the types provided in Items and) - c) appendices No. 1 to the Veterinary sanitary standard establishing the conditions of health of animals applied in case of non-commercial movement of pets.

3. To impose control over the implementation of this Resolution on the National agency on safety of foodstuff.

The veterinary sanitary standard establishing the conditions of health of animals applied in case of non-commercial movement of pets

The veterinary sanitary standard establishing the conditions of health of animals applied in case of non-commercial movement of pets (further - Veterinary sanitary standard), is brought into accord with provisions of Regulations of the European Parliament and Council of the European Union No. 998/2003 of the May 26, 2003 establishing the conditions of health of animals applied to non-commercial movement of pets and changes in the Directive No. 92/65/SEE of the Council of the European Union (The official Magazine of the European Union, L 146 of June 13, 2003, p. 1-9), the Decision of the Commission of the European Communities No. 2004/839/CE of December 3, 2004 about determination of the conditions applied to non-commercial movement, intended for the European Community of the puppies and kittens coming from the third countries (The official Magazine of the European Union, L 361 of December 8, 2004, p. 40) and Decisions of the Commission of the European Communities No. 2004/824 of December 1, 2004 about establishment of sample of the clean bill of health for non-commercial movement of dogs, cats, the domestic polecats coming from the third countries and the countries which are included into Community (The official Magazine of the Council of Europe, L 358 of December 3, 2004, p. 12-17).

Chapter I. General provisions

1. This Veterinary sanitary standard establishes the requirements to health of animals applied in case of non-commercial movement of pets and conditions of control of this movement, and also sample of the veterinary sanitary certificate for non-commercial movement of the types provided in Items and) - c) appendices No. 1.

2. In this Veterinary sanitary standard the used determinations have the following value:

pets are the animals listed in appendix No. 1 to this Veterinary sanitary standard who are not held for sale or other type of transfer into the ownership;

the passport - the document allowing to identify accurately pet including the characteristics allowing to control its status;

movement - movement of pet between the Republic of Moldova and other countries or import or return of animal from any country on the territory of the Republic of Moldova.

3. During the 5-year transition period, since day of entry into force this Veterinary sanitary standard, animals of the types listed in Items and) - c) appendices No. 1, are considered identified if have:

a) accurate, legible tattoo or;

b) electronic identification device (transponder).

4. The identification system of pets shall provide existence of some identification elements (name and the owner's address of animal).

5. After transition period as means of identification of pet the method provided in the subitem b) Item 3 is applied.

Chapter II. The conditions applied to movement of animals from abroad to the Republic of Moldova

6. The national agency on safety of foodstuff (further - the Agency) resolves import to the territory of the Republic of Moldova of puppies and kittens aged up to three months which are not vaccinated against rage if they are followed by the passport and contained in the place where were born, did not come into contact with the wild animals susceptible to infections, or are followed by mother on whom depend.

7. The agency and Customs Service take necessary measures in order that the pets imported on the territory of the Republic of Moldova were object of control of documents and identity.

8. In day of departure the owner or person accompanying pets shall provide to control facilities, according to Item 10, the passport or the veterinary sanitary certificate certifying that the animal corresponds to the conditions regulated by this Veterinary sanitary standard.

9. If by check it is determined that the animal does not conform to the requirements provided by this Veterinary sanitary standard, the Agency takes measures on:

a) to forced return of animal to country of source;

b) to the room of animal under preventive quarantine under official control for time necessary for accomplishment of special veterinary health requirements, at the expense of the owner or person accompanying pets;

c) in the last queue of euthanasia of animal without financial compensation in case forced return or quarantine is not possible.
