ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

of December 29, 2009 No. 825

About establishment of the guaranteed minimum income

(as amended on 30-12-2017)

In pursuance of the Presidential decree of the Kyrgyz Republic "About establishment of the sizes of public welfare payments" of November 13, 2009 the No. 508 Government of the Kyrgyz Republic decides:

1. Approve the enclosed Regulations on the guaranteed minimum income.

2. Ceased to be valid the Order of the Government KR of July 20, 2010 No. 131.

3. To the state agency of social security under the Government of the Kyrgyz Republic:

- to annually make calculation of the guaranteed minimum income and to submit for approval of the Government of the Kyrgyz Republic;

- carry out recalculation of monthly allowances to the needy families having children taking into account the guaranteed minimum income.

4. To the Ministry of Finance of the Kyrgyz Republic:

- provide timely allocation from the republican budget of necessary financial resources for increase in the size of the guaranteed minimum income;

- provide necessary means in the bill of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2010 and the forecast for 2011-2012".

5. Recognize invalid:

- the order of the Government of the Kyrgyz Republic of April 29, 1998 No. 231 "About establishment of the guaranteed minimum level of consumption";

- the order of the Government of the Kyrgyz Republic of October 1, 2009 No. 614 "About increase in the extent of the guaranteed minimum level of consumption".

6. To impose control of execution of this resolution on the State agency of social security under the Government of the Kyrgyz Republic.

Regulations on the guaranteed minimum income

This Provision is developed according to the Law of the Kyrgyz Republic "About public welfare payments in the Kyrgyz Republic" and establishes procedure for determination of the guaranteed minimum income applied as indicator to calculation of the size of monthly allowances to the needy families having children.

1. Concept of the guaranteed minimum income

1. The guaranteed minimum income is the indicator which is annually established by the Government of the Kyrgyz Republic determined at the rate of the budget opportunities and state of the economy taking into account subsistence minimum allowing to provide by means of the grant to the needy families having children, the vital income.

In process of development of society the guaranteed minimum income shall approach the subsistence minimum established by the legislation of the Kyrgyz Republic, and then exceed it.

2. The guaranteed minimum income is applied to calculation of the amount of rendering the public assistance to the needy families having children through system of public welfare payments taking into account inspection of degree of needs of family.

2. The purposes of introduction of concept of the guaranteed minimum income

The purposes of introduction of concept of the guaranteed minimum income are:

- calculation of the sizes of monthly allowances to the needy families having children;

- ensuring level of necessary social protection of the needy families having children.

3. Procedure of payments of the guaranteed minimum income

1. The following indicators are taken as basis of calculation of the guaranteed minimum income:

- financial and economic opportunities of the state - the amount of budgetary funds allocated for payment of monthly allowances to the needy families having children;

- the number of receivers of monthly allowance to the needy families having children - the expected number of the receivers needing public welfare payments in the corresponding year;

- the average monthly income of needy family - the actual average earnings of the needy family receiving monthly allowance in previous year.

2. Accounting of number of receivers of monthly allowance to the needy families having children, and the actual level of their income is made on the basis of the operating procedures of determination of needs.

3. The Guaranteed Minimum Income (GMI) is calculated by the following formula:

Ф - the allocated amount of budgetary funds;

SSDS - average monthly average per capita comprehensive income of needy family;

K1 - the expected number of receivers of monthly allowance to the needy families having children;

The paragraph of the sixth of Item 3 ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 30.12.2017 No. 847

K3 - the expected number of receivers of benefits to twins;

K4 - the expected number of receivers of benefits to triplets and more twins;

K5 - the expected number of receivers of benefit to children up to 3 years;

12 - the number of months in year.

4. Approval and the period of action of the guaranteed minimum income

Calculation of cost size of the guaranteed minimum income is made by annually authorized body in the sphere of social protection and affirms the Government of the Kyrgyz Republic.
