About approval of Rules of providing citizens with medicines

1. Approve the enclosed Rules of providing citizens with medicines.

2. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of October 6, 2006 No. 962 "About approval of Rules of providing citizens with medicines" (SAPP of the Republic of Kazakhstan, 2006, No. 37, the Art. 409);

2) the order of the Government of the Republic of Kazakhstan of December 21, 2007 No. 1259 "About modification of the order of the Government of the Republic of Kazakhstan of October 6, 2006 No. 962" (SAPP of the Republic of Kazakhstan, 2007, No. 47, the Art. 576).

3. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of providing citizens with medicines

1. General provisions

1. These rules of providing citizens with medicines (further - Rules) are developed according to the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" and determine single procedure for providing citizens with medicines in the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) selling price - the price of the provided medicines, specialized medical products, products of medical appointment established by results of purchase of pharmaceutical services within one administrative and territorial unit (area, the city of republican value, the capital);

2) cost recovery - the amount of compensation of public administration by local authorities health care of areas, the cities of republican value, the capital (further - local authorities of management of health care) to the supplier of cost of pharmaceutical service;

3) the list of medicines, the products of medical appointment which are subject to purchase at the single distributor (further - the list of the single distributor) - the document which is annually developed and approved by authorized body in the field of health care containing international non-proprietary names and technical characteristics of the purchased medicines, products of medical appointment;

4) pharmaceutical service - the pharmaceutical activities performed in the field of health care on production, production (except for medical equipment), wholesale and retail sale of medicines, products of medical appointment and medical equipment, connected with purchase (acquisition), storage, import, export, quality control, registration, distribution, use and destruction of medicines, products of medical appointment and medical equipment, and also ensuring their safety, efficiency and quality.

3. Providing citizens with medicines is performed:

1) when rendering the fast, stationary and hospital-replacing help within the guaranteed amount of free medical care (further - GOBMP) - according to the medicinal form;

2) when rendering the out-patient and polyclinic help within GOBMP - according to the approved authorized body in the field of health care by the list of medicines and products of medical appointment for free and (or) preferential providing the population at the out-patient level (further - the list);

3) in case of treatment by the medicines which are not included in the medicinal form - on paid basis.

4. The organization of providing citizens with medicines includes:

1) determination of need for medicines;

2) purchase of medicines, pharmaceutical services in out-patient provision of medicines;

3) delivery, distribution (redistribution), storage and accounting of medicines;

4) use (appointment) of medicines within GOBMP;

5) implementation of monitoring of side effects of medicines and submission of the reporting on providing with medicines.

5. The total requirement in medicines of areas, the cities of republican value, the capital is created based on requirement of the medical organizations by administrators of the budget programs till April 1 of year, previous to the planned year.

6. The purchase of the medicines provided by GOBMP is made according to the order of the Government of the Republic of Kazakhstan of October 30, 2009 No. 1729 "About approval of Rules of the organization and carrying out purchase of medicines, preventive (immunobiological, diagnostic, disinfecting) medicines, products of medical appointment and medical equipment, pharmaceutical services in rendering the guaranteed amount of free medical care".

2. The organization of providing with medicines when rendering the fast, stationary and hospital-replacing help within GOBMP

8. In the medical organizations the analysis of use (appointment) of medicines, results of monitoring of collateral reactions and regulation of questions of rational use of medicines is constantly performed.

9. The need for medicines for the medical organizations is determined:

1) according to the medicinal form of the medical organization;

2) based on data of dynamics of incidence and epidemiological situation in the region;

3) taking into account registers of the treated patients;

4) taking into account the actual consumption of medicines for previous year, the predicted remaining balance for January 1 of the following financial year;

10. The list for the single distributor is created and affirms authorized body in the field of health care:

1) on the basis, the republic of need for medicines provided by the medical organizations under international non-proprietary names, with indication of dosage and dosage form, and also products of medical purpose of medical procedures, necessary in case of implementation, for providing patients at the stationary level;

2) according to the republican medicinal form.
