Questions of prevention and identification of corruption in executive bodies

For the purpose of increase in efficiency of activities of executive bodies in the sphere of prevention and anti-corruption the Cabinet of Ministers of Ukraine decides:

1. Approve Standard regulations on division of executive body concerning prevention and identification of corruption which is applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Recommend to heads of the ministries, other central executive bodies, chairmen of the regional, Kiev and Sevastopol city public administrations taking into account requirements of the Standard provision approved by this resolution to form and provide functioning of divisions concerning prevention and identification of corruption within the total number of employees of central office of the ministries, other central executive bodies, the office of the regional, Kiev and Sevastopol city public administrations.

4. This resolution becomes effective from the date of publication, except Item 2 of this resolution which becomes effective since January 1, 2010.

Standard regulations on division of executive body concerning prevention and identification of corruption

The division in the activities is guided by the Constitution and the laws of Ukraine, and also the presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, international treaties of Ukraine, this Provision, other acts.

4. The main objectives of division are:

1) preparation, providing and control of implementation of actions concerning prevention of corruption;

2) provision of the methodical and consulting help with questions of observance of the anti-corruption legislation;

3) participation in information and research support of implementation of actions concerning prevention and identification of corruption, and also international cooperation in the specified sphere;

4) carrying out organizational and explanatory work concerning prevention, identification and anti-corruption.

5. Division according to the tasks assigned to it:

Develops 1), performs and controls holding actions for prevention of corruption offenses;

Provides 2) to other structural divisions of executive body, territorial authority and certain workers of explanation concerning application of the anti-corruption legislation;

3) takes measures for identification of conflict of interest and promotes its elimination, and also finds risks, favorable for making of corruption offenses, in activities official and officials of relevant organ of the executive authority, makes to the head of relevant organ offers concerning their elimination;

4) gives help in filling of declarations on property, the income, expenses and obligations of financial nature;

5) takes part in carrying out:

in accordance with the established procedure office investigation (check) in executive body, territorial authority for the purpose of identification of the reasons and conditions which promoted making of corruption offense, or failure to meet requirements of the anti-corruption legislation;

6) it is excluded;

7) it is excluded;

8) notifies in writing the head of executive body, and special divisions on fight against organized crime of the Ministry of Internal Affairs, tax police, on fight against corruption and organized crime of the SSU, Military service of law and order in Armed Forces on the facts which can demonstrate making of corruption offenses by officials of executive body, territorial authority;

9) records the employees of executive body, territorial authority made responsible for making of corruption offenses;

10) interacts with divisions concerning prevention and anti-corruption of other executive bodies, territorial authorities.

7. Assignment on division of obligations which do not belong or go beyond its powers, and also limit accomplishment of the tasks assigned to it, it is not allowed.

8. The division has the right:

To receive 1) from other structural divisions of executive body, territorial authority information and materials necessary for implementation of the tasks assigned to it, and also in the procedure established by the law information with limited access or the containing state secret;

To receive 2) from employees of executive body, territorial authority oral and written explanations on questions which arise during conducting office investigations (checks);

To initiate 4) before the head of executive body, territorial authority questions concerning the direction of requests to subjects of housekeeping, to participants of civil contracts with the obtaining purpose from them the relevant information and materials.

Employees of division during conducting office investigations (checks) have the right taking into account the restrictions set by the legislation for easy access to rooms and the territories of executive body, territorial authority, documents and materials which concern subject of office investigation (check).
