LAW OF THE REPUBLIC OF BELARUS

About the Belarusian Society of the Red Cross

This Law establishes bases of legal regulation of activities of the Belarusian Society of the Red Cross, determines forms of support of this Society by state bodies of the Republic of Belarus and feature of their relations.

Chapter 1. General provisions

Article 1. The terms applied in this Law and their determinations

For the purposes of this Law the following terms and their determinations are applied:

the volunteer - the physical person who is voluntarily performing works or rendering services on a grant basis;

armed conflict - situations as they are determined in article 2 of the Geneva convention of August 12, 1949 on improvement of fate of wounded and patients in field armies, the Geneva convention of August 12, 1949 on improvement of fate of wounded, patients and persons, castaway, from structure of armed forces at the sea, the Geneva convention of August 12, 1949 on the treatment of prisoners of war, the Geneva convention of August 12, 1949 on protection of the civilian population during war (further - Conventions), in item 4 of article 1 of the Additional protocol to the Geneva conventions of the August 12, 1949 concerning protection of the victims of the international armed conflicts (Protocol I) of June 8, 1977 (further - the Protocol I) and in article 1 of the Additional protocol to the Geneva conventions of the August 12, 1949 concerning protection of the victims of armed conflicts of not international nature (Protocol II) of June 8, 1977 (further - the Protocol II);

humanitarian activities - the activities directed to assistance including on the prevention and relief of human sufferings according to provisions of Conventions and Protocols I and II, to the victims of armed conflicts, and also persons injured with emergency situations;

emergency situation - the situation which developed in certain territory as a result of industrial accident, other dangerous situation of technogenic nature, catastrophic crash, natural hazard, natural or other disaster which entailed or can entail the human victims, damnification to human health or the environment, significant material damage and violation of conditions of activity of people.

Article 2. Coverage of this Law

This Law establishes bases of legal status of the Belarusian Society of the Red Cross, determines the purposes, tasks and the main directions it activities as the national organization of the Red Cross and governs the relations arising in case of interaction of the Belarusian Society of the Red Cross with state bodies and other organizations, and also physical persons.    

Article 3. Legal basis of activities of the Belarusian Society of the Red Cross

The legal basis of activities of the Belarusian Society of the Red Cross is constituted by the Constitution of the Republic of Belarus, this Law and other acts of the legislation of the Republic of Belarus, the Convention, Protocols I, II, the Additional protocol to the Geneva conventions of August 12, 1949 concerning acceptance of additional distinctive emblem (Protocol III) of December 8, 2005 (further - the Protocol III) and other international agreements of the Republic of Belarus, and also the Charter of the Belarusian Society of the Red Cross (further - the Charter).

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty of the Republic of Belarus.

The state gives support to the Belarusian Society of the Red Cross in implementation of the activities directed to goal achievement and accomplishment of the tasks provided by articles 10 and 11 of this Law according to the legislation of the Republic of Belarus by it.

Payment of annual fees of the Belarusian Society of the Red Cross in the International Federation of societies of the Red Cross and Red Crescent is performed at the expense of means of the republican budget.

Chapter 2. Bases of legal status of the Belarusian Society of the Red Cross

Article 4. Status of the Belarusian Society of the Red Cross

The Belarusian Society of the Red Cross is republican public association.

Regulations of the legislation of the Republic of Belarus on public associations are applied to the Belarusian Society of the Red Cross if other is not established by this Law, other legal acts of the Republic of Belarus.

Article 5. Belarusian Society of the Red Cross as component of the International movement of the Red Cross and Red Crescent

The Belarusian Society of the Red Cross is recognized the national organization of the Red Cross, single in the territory of the Republic of Belarus, and performs the activities in all territory of the Republic of Belarus.

The Belarusian Society of the Red Cross is component of the International movement of the Red Cross and Red Crescent and the member of the International Federation of societies of the Red Cross and Red Crescent.

The Belarusian Society of the Red Cross as the national organization of the Red Cross in the activities is guided by provisions of the Charter of the International movement of the Red Cross and the Red Crescent, the Charter of the International Federation of societies of the Red Cross and Red Crescent and other documents accepted within the International movement of the Red Cross and Red Crescent.

Article 6. Names of the Belarusian Society of the Red Cross

The Belarusian Society of the Red Cross has the following names which are equivalent:

in Belarusian:

complete - Respubl? Kansk to gramadskaa to the ab'yadnayena "Belaruskaye Tavarystva Chyrvonaga Kryzha";

reduced - Belaruskaye Tavarystva Chyrvonaga Kryzha;

in Russian:

complete - Republican public association "Belarusian Society of the Red Cross";

reduced - the Belarusian Society of the Red Cross;

in English - Belarus Red Cross Society.

Article 7. Emblem of the Belarusian Society of the Red Cross

The emblem of the Belarusian Society of the Red Cross represents the image of red cross in the center of white circle in frame of two red strips with the words "Belaruskaye Tavarystva Chyrvonaga Kryzha" and "Belarus Red Cross Society" written on white background between them.

The emblem of the Belarusian Society of the Red Cross can:

take place on buildings (except for roofs), in rooms, on the vehicles used by the Belarusian Society of the Red Cross and also in storage locations of the medicines, medical equipment, products of medical appointment and technical means of social resettlement belonging to it;

be hung out (to be exposed) when holding actions for acquaintance of the population with activities of the Belarusian Society of the Red Cross, to dissemination of knowledge about international humanitarian law and the International movement of the Red Cross and Red Crescent;
