RESOLUTION GOVERNMENT OF THE KYRGYZ REPUBLIC

of December 18, 2009 No. 767

About the State Customs Service under the Government of the Kyrgyz Republic

(as amended on 02-09-2019)

1. Approve enclosed:

- Regulations on the State Customs Service under the Government of the Kyrgyz Republic;

- the scheme of management of the State Customs Service under the Government of the Kyrgyz Republic.

2. Determine that the State Customs Service under the Government of the Kyrgyz Republic is legal successor of the State Customs Committee of the Kyrgyz Republic.

3. Bring in the order of the Government of the Kyrgyz Republic of June 14, 2005 No. 226 "About approval of the Regulations on Fonda of development of Customs Service of the State Customs Committee of the Kyrgyz Republic" the following changes:

- in the name and in all text of the resolution of the word "State Customs Committee of the Kyrgyz Republic" shall be replaced with words "The State Customs Service under the Government of the Kyrgyz Republic" in the corresponding cases;

in Regulations on the Fund of development of Customs Service of the State Customs Committee of the Kyrgyz Republic approved by the above-stated resolution:

- in the name and in all text of the word "State Customs Committee of the Kyrgyz Republic" and "State Customs Committee" shall be replaced with words "The State Customs Service under the Government of the Kyrgyz Republic" and "State Customs Service" in the corresponding cases.

4. Bring in the order of the Government of the Kyrgyz Republic of February 8, 2006 No. 72 "Questions of the State Customs Committee of the Kyrgyz Republic" the following changes:

- in the name and in all text of the resolution of the word of "The State Customs Committee of the Kyrgyz Republic" shall be replaced with words "The State Customs Service under the Government of the Kyrgyz Republic";

- in word preamble "and the orders of the Government of the Kyrgyz Republic of April 27, 2005 "About the State customs inspection under the Government of the Kyrgyz Republic" to exclude No. 168;

- in the name of the Regulations on flag and symbolics of the State Customs Committee of the Kyrgyz Republic approved by the above-stated resolution shall be replaced with words words of "The State Customs Committee of the Kyrgyz Republic" "The State Customs Service under the Government of the Kyrgyz Republic";

- in the Regulations on dress code and regulations of ware allowance of officials of customs authorities of the Kyrgyz Republic approved by the above-stated resolution shall be replaced with words words of "The State Customs Committee of the Kyrgyz Republic" "The State Customs Service under the Government of the Kyrgyz Republic".

5. Establish regulation of monetary compensation instead of food ration to the staff of the State Customs Service under the Government of the Kyrgyz Republic in the amount of 256 som a day.

6. To the State Customs Service under the Government of the Kyrgyz Republic to make payment of compensation instead of food ration from fund of development of Customs Service of the State Customs Service under the Government of the Kyrgyz Republic.

7. Recognize invalid:

- the order of the Government of the Kyrgyz Republic of March 28, 2007 No. 88 "Questions of the State Customs Committee of the Kyrgyz Republic";

- Item 2 of the order of the Government of the Kyrgyz Republic of June 5, 2009 No. 361 "About entering of amendments and changes into some decisions of the Government of the Kyrgyz Republic".

8. This resolution becomes effective from the date of official publication.

Regulations on the State Customs Service under the Government of the Kyrgyz Republic

1. General provisions

1. The State Customs Service under the Government of the Kyrgyz Republic (further - GTS) is the state body of the executive authority which is performing direct management of customs affairs in the Kyrgyz Republic and having the status of the armed law enforcement agency.

2. GTS in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, resolutions of Jogorku Kenesh of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic, resolutions and orders of the Government of the Kyrgyz Republic which became effective in accordance with the established procedure international treaties and agreements which participant is the Kyrgyz Republic, and this Provision.

3. GTS is legal entity, has seal with the image of the State Emblem of the Kyrgyz Republic and the name in the state and official languages, and also the accounts opened according to the procedure, established by the legislation of the Kyrgyz Republic.

4. Financing of GTS is performed at the expense of sources and means, stipulated by the legislation.

2. GTS tasks

5. The main objectives of GTS are:

- creating favorable conditions for subjects of foreign economic activity (further - persons) when moving goods and vehicles through check points on customs border of the Eurasian Economic Union;

- the improvement of quality of customs regulation promoting increase in investments into economy of the state;

- development of suggestions for improvement of the customs legislation and ensuring their realization;

- assistance to implementation of measures for protection of state security, life and health of citizens, protection of animals and plants, protection of the surrounding environment, protection of interests of domestic consumers in case of commodity importation on customs area of the Eurasian Economic Union;

- ensuring accomplishment of the international obligations of the Kyrgyz Republic in the part concerning customs affairs.

3. GTS functions

6. For accomplishment of the tasks of GTS performs the following functions:

a) functions of regulation of the relations connected with movement through customs border of goods and vehicles:

- provides application of the regulations of the Customs code of the Eurasian Economic Union regulating customs legal relationship of other international treaties and acts, constituting the right of the Eurasian Economic Union, concerning the goods and vehicles moved through check points on customs border of the Eurasian Economic Union, including moved through borders of free economic zones;

- participates in development of measures of customs affairs concerning the goods moved through check points on customs border of the Eurasian Economic Union, including moved through borders of free economic zones and will organize realization of these measures within the competence;

- will organize collection of customs payments by customs authorities when moving goods through customs border of the Eurasian Economic Union;

- coordinates functions of the state monitoring bodies at check points and places of customs clearance regarding elimination of duplication of functions;

- develops measures and creates conditions for development of customs infrastructure;
