1. Approve the enclosed Rules of lump sum payment by the non-state pension fund performing mandatory pension insurance, means of pension accruals to insured persons.

2. This resolution becomes effective since January 1, 2010.

Rules of lump sum payment by the non-state pension fund performing mandatory pension insurance, means of pension accruals to insured persons

1. These rules determine procedure the non-state pension fund performing mandatory pension insurance (further - fund), lump sum payment of means of the pension accruals considered on the retirement account of funded pension of insured person (further - lump sum payment).

2. Action of these rules extends to the citizens of the Russian Federation, foreign citizens and persons without citizenship insured in system of mandatory pension insurance who on the date of the request for lump sum payment performed forming of funded pension through fund.

2(1). Lump sum payment is performed:

a) to persons who did not acquire the right to funded pension according to article 6 of the Federal law "About Funded Pension", - on reaching age of 60 and 55 years (according to the man and the woman);

2(2). Lump sum payment is not performed to persons to whom the funded pension was established earlier.

2(3). The insured persons who exercised the right to means of pension accruals in the form of the lump sum payment having the right to address again for implementation of lump sum payment not earlier than in 5 years from the date of the previous request for payment of means of pension accruals in the form of lump sum payment.

3. Lump sum payment is established from the date of the request for it, but not earlier than from the date of emergence of the right to the specified payment.

Insured person has the right to address personally to fund behind lump sum payment by filing of application about purpose of funded pension (further - the statement) in the form approved by Fund of pension and social insurance of the Russian Federation, to direct the application by mail or to submit the application in fund in electronic form with use of information and telecommunication networks public, including the Internet, including federal state information system "The single portal of the state and municipal services (functions) (further - the single portal) which can be signed by the simple digital signature of insured person which key is received in case of corporal appearance according to the rules of use of the simple digital signature in case of the request for receipt of the state and municipal services electronically established by the Government of the Russian Federation or by the strengthened unqualified digital signature of insured person which certificate of key of check is created and it is used in the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically in the procedure established by the Government of the Russian Federation.

The application can be submitted by also legal representative or the authorized representative of insured person.

The employer has the right to address for implementation of lump sum payment to the insured faces consisting with it in employment relationships from their written consent.

The statement shall contain information on the prevention of insured person on appointment to it lump sum payment based on the statement in the presence of conditions, stipulated in Item 21 these rules.

The documents specified in subitems "an" - "in" item 4 of these rules, taking into account provisions, stipulated in Item 4(1) these rules are enclosed to the application.

Rules of the request for lump sum payment, including the employer, implementation of lump sum payment, including to persons which do not have the permanent residence in the territory of the Russian Federation of conducting verifications of the documents necessary for implementation of lump sum payment, and also the rule of maintaining pension documentation are determined according to the lists of the documents necessary for purpose of funded pension, rules of the request for funded pension approved by the Ministry of Labour and Social Protection of the Russian Federation, including the employer, purposes of funded pension and adjustment of its size, including to persons which do not have the permanent residence in the territory of the Russian Federation, conducting verifications of the documents necessary for purpose of funded pension and also rules of maintaining pension documentation taking into account the features established by these rules.

4. Are necessary for implementation of lump sum payment:

a) documents (data) proving the identity, age and the residence (the place of stay, actual accommodation), nationality of insured person;

b) documents (data) proving the identity and the residence (the place of stay, actual accommodation) of the legal representative or the authorized representative, and also the documents confirming them powers;

c) the document (data) confirming registration of insured person in system of the individual (personified) accounting;

d) the data (information) of Fund of pension and social insurance of the Russian Federation confirming availability (absence) of conditions of appointment to insured person of funded pension according to article 6 of the Federal law "About Funded Pension".

4(1). The documents necessary for implementation of lump sum payment can be provided to fund in electronic form with use of information and telecommunication networks public, including the Internet, including the single portal.

In case of the direction of the statement in electronic form with use of the single portal submission of identity documents, age, nationality, the residence (the place of stay, actual accommodation) of insured person, and also the document confirming registration of insured person in system of the individual (personified) accounting is not required.
