According to orders of the Government of the Russian Federation of February 20, 2004 N 96 "About the summary register of the organizations of defense industry complex" (The Russian Federation Code, 2004, N 9, Art. 781; 2005, N 46, Art. 4680; 2008, N 50, the Art. 5946) and of November 11, 2005 N 679 "About procedure for development and approval of administrative regulations of execution of the state functions (provision of the state services)" (The Russian Federation Code, 2005, N 47, Art. 4933; 2007, N 50, Art. 6285; 2008, N 18, 2063) I order to the Art.:

1. Approve the enclosed Administrative regulations of execution of the state function by the Ministry of Industry and Trade of the Russian Federation on maintaining the summary register of the organizations of defense industry complex.

2. Declare invalid the order of the Ministry of Industry and Energy of the Russian Federation of December 3, 2007 N 527 "About approval of Administrative regulations of execution by Federal agency on the industry of the state function on maintaining the summary register of the organizations of defense industry complex" (it is registered in the Ministry of Justice of the Russian Federation of December 29, 2007, registration N 10851).

3. To impose control of execution of this order on the deputy minister D. V. Manturov.

Administrative regulations of execution of the state function by the Ministry of Industry and Trade of the Russian Federation on maintaining the summary register of the organizations of defense industry complex

I. General provisions

1.1. These Administrative regulations of execution by the Ministry of Industry and Trade of the Russian Federation (daleeminpromtorg Russia) the state function on maintaining the summary register of the organizations of defense industry complex (daleereglament) are developed for the purpose of improvement of quality of execution of the state function on maintaining the summary register of the organizations of defense industry complex (further - the Register), and determine terms and the sequence of actions (ministerial procedures) of Minpromtorg of Russia, its structural divisions and officials with the organizations and federal executive bodies, the state corporations in which field of activity there are organizations included in the Register.

The summary register of the organizations of defense industry complex (further - the organizations) is the federal information system containing data on the organizations included in the Register, their property, financial position and cost efficiency of activities (further - information). Information containing in the Register is information of limited access and is subject to protection in accordance with the legislation of the Russian Federation.

1.2. Execution of the state function by Minpromtorg of Russia on maintaining the Register is performed according to:

The Federal Law of May 2 2006 N 59-FZ "About procedure for consideration of addresses of citizens of the Russian Federation" (The Russian Federation Code, 08.05. 2006, N 19, Art. 2060);

the order of the Government of the Russian Federation of February 20, 2004 N 96 "About the summary register of the organizations of defense industry complex" (The Russian Federation Code, 2004, N 9, the Art. 781, 2005, N 46, the Art. 4680);

the order of the Government of the Russian Federation of June 5, 2008 N 438 "About the Ministry of Industry and Trade of the Russian Federation" (The Russian Federation Code, 2008, N 24, the Art. 2868);

these Regulations.

The list of forms of statistical and accounting records which data are used for forming of the Register are given in the appendix N 7 of Regulations.

1.3. The state function is performed by Minpromtorg of Russia, Development department of defense industry complex (daleedepartament).

Within execution of the state function Minpromtorg of Russia performs interaction with Federal Service for Defence Contracts.

1.4. Resulting effects of execution of the state function are:

inclusion of the organization in the Register;

refusal in inclusion of the organization in the Register;

exception of the organization of the Register;

refusal in exception of the organization of the Register;

modification of general information about the organization included in the Register;

refusal in modification of general information about the organization included in the Register;

provision of required data from the Register;

refusal in provision of required data from the Register;

forming and updating of the database on the organizations included in the Register.

1.5. Applicants within execution of the state function on maintaining the Register are the organizations meeting the following requirements:

ensuring accomplishment of the state defensive order;

availability in property, economic maintaining or operational management of the isolated property, including the equipment and floor spaces, and also availability of qualified personnel for development, production, repair and utilization of arms, military and special equipment.

Besides, the Register joins also parent organizations (managing companies) of the integrated structures created in defense industry complex according to the decision of the President of the Russian Federation and the Government of the Russian Federation.

1.6. For implementation of the state function on maintaining the Register of the organization submit to Minpromtorg of Russia documents according to this Item of Regulations.

The register is kept on paper and electronic media. In case of discrepancy of records on papers to records on electronic media information which is written down on papers is used.

List of documents, necessary for execution of the state function:

1.6.1. Documents for inclusion of the organization in the Register:

the statement of the organization for inclusion in the Register, in form according to appendix 1 to these Regulations;

idea of federal executive body, the state corporation in which field of activity there is organization of its inclusion in the Register (in the absence of the specified representation the organization proves impossibility of its representation);

the copies of constituent documents certified in accordance with the established procedure;

copies of balance statements with mark of tax authority on acceptance for the last reporting and two prior years;

information on forms according to appendices 2 - 6 to these Regulations, confirming compliance of the organization to the established requirements. At the same time degree of privacy (confidentiality) of information is determined by contractors according to requirements of legal and other regulatory legal acts of the Russian Federation in the field of protection of the state secret and confidential information.

1.6.2. Documents for exception of the organizations of the Register:

representation of federal executive body, the state corporation in which field of activity there is organization, about exception of the organization of the Register;

information on forms according to appendices 2 - 6 to these Regulations confirming discrepancy of the organization to the established requirements or the documents confirming liquidation of the organization as the legal entity in the cases established by the current legislation, and also the termination of activities as a result of reorganization.

1.6.3. Documents for modification of general information on the organization included in the Register (are provided in case of change of the main data on the organization specified in appendix 2 to these Regulations):

the documents containing information on the happened changes;

information on forms according to appendices 2 - 4 to these Regulations.

1.6.4. The documents submitted to Minpromtorg of Russia for updating of the database on the organizations included in the Register:

quarterly - information on form according to appendix 5 to these Regulations;

annually:

the copies of constituent documents certified in accordance with the established procedure (are represented in case of introduction of changes in them in reporting year);
