For the purpose of providing accurate procedure for preparation and holding meetings of the Plenum, and also the organization of proper control over the implementation of the decisions made by it, the Plenum of the Supreme Economic Court of the Republic of Uzbekistan, being guided by Art. 46 of the Law of the Republic of Uzbekistan "About courts",

DECIDES:

Approve Regulations of the Plenum of the Supreme Economic Court of the Republic of Uzbekistan.

1. General provisions

1.1. According to the Law of the Republic of Uzbekistan "About courts" and the Economic Procedure Code of the Republic of Uzbekistan, the Plenum of the Supreme Economic Court resolves important issues of law-enforcement and organizational activities of economic courts of the Republic of Uzbekistan.

1.2. Judges of the Supreme Economic Court, chairmen of economic courts of the Republic of Karakalpakstan and areas are part of the Plenum.

1.3. The Attorney-General participates in meetings of the Plenum.

1.4. By the invitation of the Chairman of the Supreme Economic Court Chairmen of the Constitutional and Supreme Court, the Minister of Justice of the Republic of Uzbekistan, members of Scientific and advisory council under the Supreme Economic Court, representatives of the ministries, departments, scientific institutions, other bodies of the public, economic board and public associations can participate in meeting of the Plenum.

1.5. The plenum is competent in the presence of at least two thirds of its structure.

1.6. The plenum is convened by the Chairman of the Supreme Economic Court of the Republic Uzbekistan less often than two times a year.

1.7. Plenum of the Supreme Economic Court:

a) considers cases according to the procedure of supervision;

b) considers materials of generalization of court practice and makes explanations concerning application of the legislation;

c) approves structure of Presidium, chairmen of judicial boards, and also the secretary Plenum on representations of the Chairman of the Supreme Economic Court;

d) approves on representation of the Chairman of the Supreme Economic Court structure of Scientific and advisory council under the Supreme Economic Court;

e) hears messages on work of Presidium, and also reports of chairmen of judicial boards of the Supreme Economic Court on activities of boards;

e) hears reports of chairmen of economic courts of the Republic of Karakalpakstan and areas on practice of application of the legislation, and also on accomplishment of the leading explanations of the Plenum of the Supreme Economic Court;

g) elects Qualification board of judges and hears messages on its activities;

h) approves structure of editorial board of publication of the Supreme Economic Court;

i) performs other powers conferred to it by the legislation.

2. Procedure for preparation of meetings

2.1. Meetings of the Plenum are held according to the work plan of the Supreme Economic Court of the Republic of Uzbekistan. The work plan determines also the agenda of each meeting. The agenda of meeting of the Plenum joins also unplanned questions according to proposals of members of the Plenum.

2.2. The list of the questions offered for consideration at the next Plenum's meeting is constituted previously by the secretary Plenuma, previously is constituted by the secretary Plenuma and reported on the Chairman of the Supreme Economic Court of the Republic of Uzbekistan or person fulfilling its duties for decision making on their introduction for Plenum's consideration.

2.3. About time of convocation of the Plenum and questions submitted for its consideration, members of the Plenum and invited are notified not later than 20 days prior to meeting.

2.4. On the questions submitted for consideration of Plenum, contractors present materials in the form: drafts of resolutions of Plenum on statement of structure of Presidium, chairmen of judicial boards, the secretary Plenum, structure of Scientific and advisory council under the Supreme Economic Court, structure of editorial board of publication of the Supreme Economic Court; reports for work of Presidium, chairmen of judicial boards of the Supreme Economic Court about activities of boards and the corresponding drafts of resolutions of Plenum for the matters; projects of suggestions for improvement of the current legislation; reports and drafts of the relevant resolutions; protest on the resolution of Presidium of the Supreme Economic Court on specific legal case; generalization of practice of economic courts and the corresponding draft of the resolution on giving explanations concerning application of the legislation, etc.

2.5. Materials on the Plenum are prepared by chairmen of judicial boards, heads of managements, departments and other employees of the Supreme Economic Court, members of the Plenum are judges of the Supreme Economic Court of the Republic of Uzbekistan, chairmen of economic courts of the Republic of Karakalpakstan and areas. Members of Scientific and advisory council under the Supreme Economic Court of the Republic of Uzbekistan, specialists and scientists of organizations and organizations in coordination with their heads can be involved in preparation of materials. Direct contractors are responsible for timely and high-quality preparation of materials. Materials shall be vised by them.

2.6. The materials intended for consideration on Plenuma are transferred to the secretary Plenuma not later than 30 days prior to Plenum's meeting.

2.7. Mailing of draft documents on the discussed general questions to Plenum and Generalnomu prokuroru's members is performed by the secretary Plenuma in twenty days prior to meeting.

Mailing of the above-named draft documents by other persons, invited for participation in Plenum's work, is performed by the secretary Plenuma on specifying of the Chairman of the Supreme Economic Court, and in case of its absence - his deputy not later than ten days prior to Plenum's meeting.

2.8. About non-presentation of materials at the scheduled time the secretary Plenuma reports on the Chairman of the Supreme Economic Court of the Republic of Uzbekistan together with explanations of executives in charge for decision making on removal of question from consideration Plenuma.
