The government of the Russian Federation and the Government of the Republic of Byelorussia which are hereinafter referred to as by the Parties
based on provisions of the Agreement on the Union of Belarus and Russia of April 2, 1997 and the Charter of the Union of Belarus and Russia of May 23, 1997,
considering cost efficiency of creation of the Joint electric utility system,
agreed as follows:
The parties create the Joint electric utility system allowing to use most effectively energy carriers and energy capacities of both power supply systems on voluntary basis.
Considering that creation of the Joint electric utility system at the initial stage is understood as joint synchronous operation of power supply systems of Russia and Belarus, coordinate dispatching management of power plants and the high-level power supply networks and, considering that power supply systems work in the single technological mode:
The parties will ensure parallel functioning of power supply systems;
The parties do not create special body of management of power supply system and charge to carry out operational management by working hours of the Joint electric utility system according to the Central dispatching management of Power pool system of Russia and Interconnected dispatching office of the Integrated power system of Belarus.
The principles of parallel work are regulated by the documents which are mutually approved by the Parties, instructions and provisions on dispatching management of parallel operation of the Power pool system of Russia and the Integrated power system of Belarus, the delivery contracts and exchange of electrical energy concluded between the Russian joint stock company "UES of Russia" and the Belarusian state energy concern.
When forming restructuring programs of the companies of fuel and energy complex of the Republic of Byelorussia the Belarusian Side will provide deepening of integration with the Russian joint stock company "UES of Russia".
Proceeding from the fact that at the following stage development of the Joint electric utility system will be made based on the property relations the Belarusian Side will carry out incorporating the Belarusian power.
For this purpose:
will develop the program of incorporating the companies of power industry of the Republic of Byelorussia providing creation of the efficient market of electric power producers;
will develop procedure and conditions of open entry of consumers to network;
will prepare offers on integration of power supply systems of the Russian Federation and the Republic of Byelorussia at mutually advantageous conditions.
The parties will develop the main regulating legal documents providing functioning of the Joint electric utility system and the integrated wholesale market of electrical energy (capacity) of Russia and Belarus.
The parties jointly will develop the controling mechanism the Joint electric utility system.
The Belarusian Side assumes functions of the organizer of the wholesale market of electrical energy in the Republic of Byelorussia providing taking into account the developed procedures and conditions, open entry to networks of all producers and large consumers of the electric power. In Belarus the Belarusian Side will develop the following normative legal documents for functioning of the wholesale market of electrical energy (capacity):
about state regulation of rates for electrical and heat energy;
about the wholesale market of electrical energy (capacity);
about bases of pricing and procedure for state regulation and application of rates for electrical and heat energy.
The parties will promote creation of the approved mechanism of forming of rates for energy carriers, including the electrical and heat energy and capacity providing functioning of the integrated wholesale market of electrical energy (capacity) of Russia and Belarus, profitable work and development of the Joint electric utility system.
The parties intend to perform mutually beneficial economic cooperation and collateral actions in the field of power industry, including on questions:
productions, transfers and distributions of electrical energy and capacity;
development strategies of the Joint electric utility system, systems and controls;
the current and perspective fuel supply on the basis of overall balances;
developments of single transportation power networks, scientific research, designings, upgrades, modernization and reconstruction operating and construction of new energy objects, proceeding from perspective balances of the electric power and capacity of both countries;
forming of single normative and technical and technological, information space in the field of power industry and energy construction;
creations of single emergency inventory of processing equipment and spare parts;
training, preparation and retraining of personnel for power;
cooperations of energy, machine-building and other enterprises for development of technological base of power, including by creation of financial and industrial groups and other associations.
Shall provide the parties:
protection of property rights of the organizations participating in joint businesses and projects in the field of power in the territories of the states;
mutual aid in case of natural disaster response and accidents on power objects, in financing of the joint state programs directed to increase in reliability and stability of these objects;
security guarantees and legal protection of the specialists involved to performance of works on power generation facilities according to the legislation of the states, and assistance in the solution of social problems.
The parties will promote expansion of mutual deliveries of material resources for work on repair of the equipment, reconstruction and modernization of the energy companies.
The parties will develop the concept of collateral actions in the international activities for questions of power industry and will provide carrying out single policy in relations with power supply systems of other countries.
The parties will develop the program of joint development and operation of the existing and again constructed interstate power lines for the purpose of creation of conditions for stable electric utility service of own needs, and also export (transit) of the electric power to other countries of the Commonwealth of Independent States and the third countries.
