Agreement between the Government of the Russian Federation and Government of the Republic of Belarus on coordination of activities of rail transport

of July 20, 1992

The government of the Russian Federation and the Government of the Republic of Belarus which are hereinafter referred to as with the Parties

confirming the property right to the rail transport belonging to the Russian Federation and the Republic of Belarus,

considering expedient preserving technological unity of railway transportation network,

recognizing exclusive importance of transportations of passengers and loads both between the Parties, and to the third countries,

attaching significance to coordination and joint activities of rail transport of both states,

agreed as follows:

Article 1

Functional activities of rail transport of the Russian Federation and the Republic of Belarus, and also production and content of railway vehicles, technical means, safety of movement and working conditions, the organization of transportation work, safety of loads, interaction of rail transport with users of its services and other modes of transport are performed according to single standard rates.

Article 2

The parties perform the coordinated tariff policy. Rates in the interstate message are established by special agreements.

Transportation of passengers and loads between stations of the railroads of both states is performed on the basis of the regulating documents acting at the time of the signature of this agreement.

Under the organization of transportations of passengers and loads by rail from the Russian Federation transit across the territory of the Republic of Belarus and from the Republic of Belarus transit across the territory of the Russian Federation, and also en route from the third countries to the third countries of the Party coordinate the actions in case of development, taking into account the legislation of the states, tariff policy for the purpose of attraction of additional transit cargo flows on these directions and registration, in necessary cases, the relevant agreements.

Article 3

The parties keep the operating procedure of international carriages of loads and passengers by rail established by earlier signed intergovernmental agreements and conventions in the field of rail transport which participant was the former USSR.

The list of such agreements and conventions is determined by the Parties the free standing agreement.

Each of the Parties in case of the conclusion with the third countries of the Agreements in the field of transport changing the procedure established by the Agreements specified in 1 paragraph of this Article will inform on it other party.

Article 4


will keep the developed technological bonds between the railroads of both states;

will install system of responsibility for violation of technological parameters of transportation work;

will carry out mutually agreed competent authorities of Obligation parties on acquisition, availability in operation and repair of railway vehicles, containers, the machinery and equipment;

will keep the existing scheme of the address of passenger trains, the directions of traffic volumes and cargo flows, the plan of forming of cargo trains, sites of servicing of trains traction means and crews of train. Changes, in case of need, will be performed according to the mutual arrangement of competent authorities of the Parties;

will grant the right to relevant organs of control of railway transport to hold negotiations on economic evaluation and accounting of mutual interests, determination of procedure for preparation and approval of technological parameters of transportation work.

Article 5

The parties will render assistance in ensuring mutual deliveries of the equipment, the equipment, spare parts and material resources for needs of rail transport.

Article 6

The parties will coordinate social policy concerning workers of rail transport, informing each other on the preparing decisions.

Article 7

The parties are developed and pursue single scientific and technical policy on rail transport.

Article 8

The parties will cooperate in area of training of engineers, technicians, workers of mass professions of rail transport and development of single requirements to the level of their preparation, and also recognize that the qualification documents issued about the termination of educational institution will have equal legal force in the territory of both states.

Article 9

Changes and amendments to this agreement are drawn up by protocols which are integral part of the Agreement.

Article 10

The parties declare that this Agreement is open for signing of any state by the government which railway system has technological communication with railway system of the Russian Federation and the Republic of Belarus or other state which joined this Agreement.

Article 11

This agreement becomes effective from the moment of its signing and will be effective until the expiration of 90 days from the date of when one of the Parties reports to other Party in writing about the intention to terminate this agreement.

It is made in Moscow on July 20, 1992 in duplicate, everyone in the Russian and Belarusian languages, and both texts are equally authoritative.
