The agreement between the Government of the Russian Federation and the Government of the Republic of Belarus on the basic principles and conditions of relations in the field of oil transportation

of July 20, 1992

The government of the Russian Federation and the Government of the Republic of Belarus which are hereinafter referred to as with the Parties;

recognizing that bulk distribution lines of the Parties are mutually deeply integrated and are base of development of many industries of economy of the Parties;

being guided by the purpose of effective use of the existing system of transport, storage and oil refining, and also forming of the joint oil and gas market;

recognizing that establishment of the single principles of functioning of systems of bulk distribution lines most fully is equitable to interests of the Parties;

considering that carrying out uniform policy in the relations with the third countries is equitable in oil and gas industry to interests of the Parties and promotes increase in efficiency of their participation in international backgrounds,

agreed as follows:

Article 1

The parties keep action in the territories of the rules, provisions, instructions, standards, specifications and other regulations regulating work of pipeline transport.

Article 2

The parties keep the developed scientific and technical bonds in research and development of problems of pipeline transport, preparation of scientific and technical personnel.

Article 3

The parties authorize the state companies for transport of oil to perform the joint and coordinated actions aimed at providing uninterrupted and steady oil supply of consumers of the Russian Federation, the Republic of Belarus and the third countries by transit of oil across the territory of the Republic of Belarus with use of the developed trunk oil pipeline system.

Article 4

Scopes of supply of oil of the Republic of Belarus from the Russian Federation are determined by the free standing agreement of the Parties.

The price of the oil delivered to the Republic of Belarus is established by agreements between the Parties.

Article 5

The parties provide functioning of system of the main pipeline transport as the single technological system acting on the basis managements from one center and the approved delivery schedule.

Article 6

Payment for services in transport of oil is made on the approved rates developed by the companies for the technique approved by the Parties.

Article 7

The parties for the purpose of ensuring life activity of objects of the petrotransport systems providing requirements of the Parties will perform mutual deliveries of material resources in agreed volumes and the nomenclature.

Article 8

In case of emergencies on oil transport objects agents of the parties will give each other mutual aid the equipment, specialists and material resources for bystreyshy accident elimination and recovery of transport functions of system.

Article 9

On the questions which are not settled in this agreement connected with transit of oil across the territory of the Republic of Belarus the laws and rules existing in the territory of the Republic of Belarus are applied.

Article 10

The solution of the practical questions arising in connection with application of this agreement is performed between the state companies of the Parties by consultations.

Article 11

This agreement does not affect the rights and obligations of the Parties according to international agreements and agreements which participants they are.

Article 12

This agreement becomes effective from the moment of its signing and will be effective before the expiration of 6 months from the date of when one of the Parties reports other Party by the written notice of the intention to terminate this agreement.

It is made in Moscow on July 20, 1992 in duplicate, everyone in the Russian and Belarusian languages, and both texts are equally authoritative.
