The customs union agreement on veterinary and sanitary measures

of December 11, 2009

(as amended on on May 21, 2010)

The governments of state members of custom union within Eurasian economic community (further - custom union) which are hereinafter referred to as with the Parties for the purpose of forming of custom union,

based on the Agreement on carrying out coordinated policy in the field of technical regulation, sanitary and phytosanitary measures of January 25, 2008,

recognizing feasibility of carrying out single policy in the field of veterinary science,

in view of rules and the principles of the Sanitary code of land animals and the Sanitary code of water animals of the International epizootic bureau, and also the Agreement on cooperation of veterinary science of state members of the CIS of March 12, 1993; Agreements on technical barriers in trade and Agreements on application of the sanitary and phytosanitary measures of the World Trade Organization taken following the results of the Uruguayan round of multilateral trade negotiations on April 15, 1994 to Marrakech

for the purpose of ensuring protection of customs area of custom union from import and distribution of causative agents of infectious diseases of animals, including general for the person and animals, and the goods (products) which are not conforming to veterinary (veterinary and sanitary) requirements

agreed as follows:

Article 1

In this agreement the following concepts are used:

"veterinary control (supervision)" - the activities of authorized bodies directed to prevention of import and distribution of causative agents of infectious diseases of animals, including general for the person and animals, and the goods (products) which are not conforming to veterinary (veterinary and sanitary) requirements and also the prevention, detection, suppression of violations of the law of custom union and the legislation of the states of the Parties in the field of veterinary science;

"veterinary and sanitary measures" - requirements, obligatory for execution, and the procedures applied for the purpose of the prevention of diseases of animals and protection of the population against diseases, general to the person and animals in connection with the arising risks, including in case of transfer or distribution by their animals, with sterns, raw materials and products of animal origin, and also vehicles transporting them, within customs area of custom union;

"authorized bodies" - the state bodies and organizations of the states of the Parties performing activities in the field of veterinary science.

The terms which specially are not determined in this agreement are used in the values established by other international treaties signed within custom union.

Article 2

Action of this agreement extends to goods (products) under control to veterinary control (supervision), including the goods for private use (further - controlled goods) moved through customs border of custom union and on customs area of custom union, included in the Single inventory, subject to veterinary control (supervision) (further - the Single list).

Controlled goods shall correspond Single veterinary (veterinarno - sanitary) to requirements imposed to the goods which are subject to veterinary control (supervision) (further - Single veterinary requirements) and are subject to mandatory veterinary control (supervision) according to Regulations on single procedure of veterinary control on customs border of custom union and on customs area of custom union (further - Regulations on single procedure for control).

Article 3

Authorized bodies exercise veterinary control (supervision) when moving controlled goods through customs border of custom union at check points through frontiers of the states of the Parties or in other places determined by the legislation of the states of the Parties (further - check points) which are equipped and equipped with means of veterinary control according to the legislation of the states of the Parties.

Article 4

1. Each batch of controlled goods is imported on customs area of custom union according to Single veterinary requirements and on condition of availability: the permission issued by authorized body on which territory of the state the specified goods, according to Regulations on single procedure for control, and (or) the veterinary certificate issued by competent authority of the country of departure of the specified goods are imported.

On the basis of Single veterinary requirements authorized bodies can approve bilaterally samples of veterinary certificates on the controlled goods imported on single customs area of custom union included in the Single list with competent authorities of the country of the sender (third party). Samples of the specified veterinary certificates go to the Commission of custom union (further - the Commission) for their transfer to check points.

The controlled goods placed under customs procedure of transit are transported on customs area of custom union according to Regulations on single procedure for control.

2. Controlled goods are transported from the territory of the state of one Party on the territory of the state of other Party according to Single veterinary requirements and are followed by the veterinary certificate.

The parties mutually recognize the veterinary certificates issued by authorized bodies in the single forms approved by the Commission.

Article 5

1. Based on Single veterinary requirements, authorized bodies take measures for non-admission of import and distribution on customs area of custom union of causative agents of infectious diseases of animals, including general for the person and animals, and the goods (products) of animal origin dangerous in the veterinary and sanitary relation.

2. Authorized bodies:

in case of detection and distribution in the territory of their states of infectious diseases of animals, including general for the person and animals, and the goods (products) of animal origin dangerous in the veterinary and sanitary relation, without delay, after official establishment of the diagnosis or confirmation of insecurity of goods (products), send information on them, and also about the taken veterinary and sanitary measures to the Information system of EurAsEC in the field of technical regulation, sanitary and phytosanitary measures and the Integrated information system of foreign and mutual trade of custom union;

timely notify the Commission on changes in the list of dangerous and quarantine diseases of animals of the state of the Party;

render each other scientific, methodical and technical assistance in the field of veterinary science.
