The customs union agreement on sanitary measures

of December 11, 2009

The governments of state members of custom union within Eurasian economic community (further - custom union) which are hereinafter referred to as with the Parties for the purpose of ensuring protection of customs area of custom union from delivery and spread of infectious and mass noninfectious diseases (poisonings) among the population, products (goods) which are not conforming to sanitary and epidemiologic and hygienic requirements based on the Agreement on carrying out coordinated policy in the field of technical regulation, sanitary and phytosanitary measures of January 25, 2008, recognizing feasibility of carrying out coordinated policy in the field of ensuring sanitary and epidemiologic wellbeing of the population, in view of the International medical and sanitary rules (2005), the Agreement on technical barriers in trade and Agreements on application of sanitary and phytosanitary measures of the World Trade Organization, the multilateral trade negotiations accepted following the results of the Uruguayan round on April 15, 1994 to Marrakech, the Agreement on cooperation in the field of sanitary protection of the territories of the State Parties of the Commonwealth of Independent States of May 31, 2001, the Agreement on order of interaction in case of hygienic assessment of potentially dangerous products imported to the State Parties of the Commonwealth of Independent States of April 16, 2004 agreed as follows:

Article 1

For the purposes of this agreement the following basic concepts are used:

"the document confirming safety of products (goods) "the document (the certificate on state registration) certifying compliance of products (goods) which are subject to sanitarnoepidemiologichesky supervision (control), safety requirements for health of the person and issued by authorized bodies;

"sanitary and epidemiological surveillance (control)" - the activities of authorized bodies directed to the prevention, detection and suppression of violations of the mandatory requirements established by regulatory legal acts of custom union and the legislation of the states of the Parties in the field of sanitary and epidemiologic wellbeing of the population;

"sanitary and anti-epidemic actions" - the organizational, administrative, technical, medical and sanitary and other measures directed to risk assessment of harmful effects per capita of habitat factors, its elimination or reduction, prevention of origin and spread of infectious and mass noninfectious diseases (poisonings) and their liquidation;

"controlled goods" - the goods, chemical, biological and radioactive materials, waste and other loads constituting danger to the person, the foodstuff, materials and products moved through customs border of custom union and on customs area of custom union, which are subject to the state sanitary and epidemiological surveillance (control) according to the legislation of the states of the Parties;

"authorized bodies" - bodies and organizations of the states of the Parties authorized in the field of sanitary and epidemiologic wellbeing of the population.

The terms which specially are not determined in this agreement are used in the values established by other international treaties signed within custom union.

Article 2

Action of this agreement extends to persons, vehicles, and also the controlled goods included in the Single inventory, which are subject to sanitary and epidemiological surveillance (control) on customs border and customs area of custom union (further - the Single inventory).

Sanitary and epidemiological surveillance (control) on customs border and customs area of custom union is carried out according to Regulations on procedure of the state sanitary and epidemiological surveillance (control) of persons and vehicles crossing customs border of custom union, the controlled goods moved through customs border of custom union and on customs area of custom union (further - Regulations on procedure for sanitary and epidemiological surveillance).

On customs area of custom union Single sanitary and epidemiologic and hygienic requirements are applied to the goods which are subject to sanitary and epidemiological surveillance (control) (daleeediny health requirements). Single health requirements affect before adoption of technical regulations of EurAsEC the corresponding type of controlled goods.

For the purpose of accomplishment of this agreement of the Party:

- recognize results of works of authorized bodies on determination of compliance of controlled goods to Single health requirements;

- take the agreed measures directed to the prevention of delivery, distribution and liquidation on customs area of custom union of infectious and mass noninfectious diseases (poisonings) hazardous to health of the person, effects of emergency situations, and also acts of terrorism using biological agents, chemical and radioactive materials;

- perform sanitary and anti-epidemic actions for non-admission of import to customs area of custom union and turnover life-threatening, health of the person and the circle of its dwelling of controlled goods.

Article 3

The parties exercise sanitary and epidemiological surveillance (control) concerning persons, vehicles, controlled goods in case of their movement through customs border of custom union at check points of the states of the Parties located on customs border of custom union.

The parties create at the check points intended for movement of controlled goods through customs border of custom union, sanitary and quarantine Items and take measures for holding necessary sanitary and anti-epidemic actions.

The commission of custom union determines the list of controlled goods which movement through customs border of custom union is performed at specially equipped check points determined by the relevant Parties according to their legislation.

Article 4

Authorized bodies exchange samples of the documents confirming safety of products (goods) which are drawn up in Single forms and lists of the bodies and organizations performing their issue.

Article 5

Import and the address of controlled goods on customs area of custom union is performed in the presence of the document confirming safety of products (goods).

The parties recognize the documents confirming safety of products (goods) included in the Single inventory, issued by authorized bodies in the Single form and certifying compliance of products (goods) to Single health requirements, technical regulations of EurAsEC without renewal.

The documents confirming safety of products (goods), which are drawn up by authorized bodies before entry into force of this agreement are effective before the expiration of their action in the territory of the state of the Party which issued this document.
