The customs union agreement about quarantine of plants

of December 11, 2009

(as amended on on May 21, 2010)

The governments of state members of custom union within Eurasian economic community (further - custom union) which are hereinafter referred to as with the Parties for the purpose of forming of custom union, based on the Agreement on carrying out coordinated policy in the field of technical regulation, sanitary and phytosanitary measures of January 25, 2008, recognizing feasibility of carrying out coordinated policy in scope of quarantine phytosanitary requirements and measures, in view of rules and the principles of the International convention on quarantine and protection of plants (Rome, 1951, in edition of 1997) (further - the Convention), Agreements on technical barriers in trade and Agreements on application of the sanitary and phytosanitary measures of the World Trade Organization taken following the results of the Uruguayan round of multilateral trade negotiations on April 15, 1994 to Marrakech for the purpose of ensuring protection of customs area of custom union from delivery and distribution of quarantine objects and decrease in the losses caused by them, and also removal of obstacles in international trade in quarantine products, agreed as follows:

Article 1

For the purposes of this agreement the following basic concepts are used:

"quarantine objects (quarantine harmful organisms)" - the harmful organisms which are absent or restrictedly extended in the territories of the states of the Parties and brought in national Lists of quarantine objects;

"phytosanitary quarantine control (supervision)" - the activities of the national authorities of the states of the Parties given authority in the field of quarantine of plants directed to identification of quarantine objects, establishment of quarantine phytosanitary condition of quarantine products and accomplishment of the international obligations of the states of the Parties and the legislation of the state in the field of quarantine of plants;

"the quarantine products (quarantine freights, quarantine materials, quarantine goods)" (further - "quarantine products") - plants, products of plant origin, container, packaging, loads, the soil, organisms, or the materials moved through customs border of custom union and on customs area of custom union which can be carriers of quarantine objects and (or) promote their distribution and concerning which acceptance of quarantine phytosanitary measures is necessary;

"batch of quarantine products" - quantity of the quarantine products intended for sending by one vehicle to one destination to one receiver.

The concepts which specially are not determined in this agreement are used in the values established by the Convention, international standards on quarantine phytosanitary measures by international treaties signed within custom union and Eurasian economic community.

Article 2

Action of this agreement extends to the quarantine products included in the List of the quarantine products (quarantine freights, quarantine materials, quarantine goods) which are subject to phytosanitary quarantine control (supervision) on customs border of custom union when importing and on customs area of custom union (further - the List of quarantine products).

Phytosanitary quarantine control (supervision) on customs border of custom union is exercised according to Regulations on procedure of phytosanitary quarantine control (supervision) on customs border of custom union.

Phytosanitary quarantine control (supervision) on customs area of custom union is exercised according to Regulations on procedure of phytosanitary quarantine control (supervision) on customs area of custom union.

Phytosanitary quarantine control (supervision) when exporting quarantine products from customs area of custom union is exercised according to the international obligations of the states of the Parties in the field of quarantine of plants and the legislation of the states of the Parties.

Article 3

The given authority national authorities of the states of the Parties on implementation of this agreement are the bodies of the states of the Parties performing functions of phytosanitary quarantine control (supervision) (further - authorized bodies).

The parties take necessary measures for prevention of delivery on customs area of custom union and distribution on it quarantine objects (quarantine harmful organisms) and bear responsibility for observance of the international obligations of the states of the Parties and the legislation of the state in the field of quarantine of plants.

Article 4

1. Authorized bodies of the Parties exercise phytosanitary quarantine control (supervision) when moving quarantine products through customs border of custom union at check points of the states of the Parties or in other places in which according to the legislation of the states of the Parties Items on quarantine of plants (phytosanitary control posts) are equipped and equipped.

2. The quarantine products imported on customs area of custom union shall conform to phytosanitary requirements of the state of the Party in the territory of which the destination of quarantine products is located.

The parties provide placement of official information on the phytosanitary requirements imposed to the imported quarantine products on the official sites (the Internet - resources) authorized bodies of the Parties, and also in the Information system of Eurasian economic community in the field of technical regulation, sanitary and phytosanitary measures and in the Integrated information system of foreign and mutual trade of custom union.

Each batch of the quarantine products carried according to the List of quarantine products to group of quarantine products with high phytosanitary risk is imported on customs area of custom union accompanied by the export or reexport phytosanitary certificate issued by competent authority of the state of the exporting country (reexporter) in the form established by the Convention.

3. Each batch of the quarantine products carried according to the List of quarantine products to group of quarantine products with high phytosanitary risk, transported from the territory of the state of one Party on the territory of the state of other Party shall be followed by the phytosanitary certificate of the Party - the sender in the form established by the Convention.

The parties recognize the phytosanitary certificates issued by authorized bodies of the states of the Parties.

Phytosanitary quarantine control (supervision) in destinations of quarantine products in the territories of the states of the Parties is exercised according to Article 2 of this agreement.

Article 5

1. The list of quarantine products, Regulations on procedure of phytosanitary quarantine control (supervision) on customs border of custom union, Regulations on procedure of phytosanitary quarantine control (supervision) on customs area of custom union, affirm the decision of the Commission of custom union (further - the Commission).
