About use of airspace
This Law determines the basic legal, economic and organizational provisions of use of airspace of the Republic of Armenia (further - airspace).
State regulation of use of airspace of the state directed to requirements satisfaction, the companies, organizations and the organizations, and also in the field of airborne transportations, aerial works and rendering other services, safety-of-life function, defense capability and safety of the state.
The Republic of Armenia possesses complete and exclusive sovereignty over airspace of the Republic of Armenia.
Airspace is airspace over the overland and water territory of the Republic of Armenia which is considered integral part of the territory of the Republic of Armenia.
Use of airspace is regulated by the Constitution of the Republic of Armenia, international treaties of the Republic of Armenia, this Law and other legal acts.
Operation of this Law extends to all air territory, and also beyond its limits - to the air territories where, according to international treaties of the Republic of Armenia, responsibility for air traffic management is born by the Republic of Armenia.
Operation of this Law extends to all subjects of the Republic of Armenia and foreign states using the above-stated airspaces on all bodies performing the organization of use of airspace and air traffic maintenance.
If international treaties of the Republic of Armenia establish other regulations than provided by this Law, then regulations of these agreements are applied.
Use of airspace includes flights of air vehicles, rockets firing, and also explosive works, other activities connected with finding of objects in airspace in motionless condition and in movement which can pose threat to air traffic.
Airspace users acquire the attribution of utilization of airspace according to the procedure, established by the Government of the Republic of Armenia.
State regulation of airspace is performed by the representative and the sphere of civil aviation by state body which determines procedure for use of airspace and exercises the state supervision of observance of this procedure.
Public administration of use of airspace in special conditions of use of airspace is exercised of authorized body of public administration in the field of defense.
Conditions of use of airspace are considered special in case of the announcement of warlike situation according to the procedure, established by the legislation of the Republic of Armenia, and also if necessary to fight back air attack on the Republic of Armenia, to take actions for the prevention or suppression of violation of frontier and procedure for use of airspace.
Activities in the field of the organization of use of airspace and air traffic control, and also the specialists working in this area are subject to licensing.
The equipment used in the field of the organization of use of airspace and air traffic control, and airways are subject to obligatory certification. in the absence of appropriate certificates their operation is forbidden.
Use of airspace will be organized by authorized body of public administration in the field of civil aviation and the specialized organization organizing use of airspace and air traffic.
Treat tasks of the organization of use of airspace:
a) determination of structure of airspace;
b) ensuring use of system of priorities of use of airspace;
c) planning and coordination of use of airspace;
d) air traffic management;
e) supervision of observance of procedure for use of airspace;
e) application of restrictions and prohibitions in use of airspace.
The structure of airspace includes areas, zones and routes of air traffic maintenance, areas of airfields and airdrome complexes, special zones and special routes of flights of air vehicles, prohibited, danger areas and zones of limited use, areas of explosive works, polygons, other elements established for the purpose of implementation of activities in airspace.
The procedure for determination of structure of airspace is established by the Government of the Republic of Armenia.
In need of simultaneous use of airspace by different users the following consecutive system of priorities of use of airspace is applied:
a) repulse to air attack on the Republic of Armenia, prevention or crossing of violations of frontier;
b) the prevention of the natural or other disasters and accidents, liquidation which arose owing to emergency situations or rendering in such cases of the help for the purpose of rescuing of life of people;
c) prevention or suppression of violation of procedure for use of airspace;
d) the flights and other activities which are carried out according to the orders of the Government of the Republic of Armenia or established procedure;
e) the military flyings which are carried out for the purpose of the brought check of readiness of Armed Forces;
e) regular passenger traffic;
g) flights of state court martials;
h) regular carriages of goods and mails;
i) non scheduled air transports, accomplishment of aerial and other works;
j) flights of test aircraft;
k) training, operational, demonstration flights and other actions;
l) the flights connected with satisfaction personal needs of citizens and other activities.
Planning and coordination of use of airspace, including air traffic management, are performed by the bodies organizing use of airspace.
Planning and coordination of use of airspace are performed based on system of priorities, the stipulated in Clause 12 these Laws.
