Contract between the Russian Federation and Republic of Belarus on military cooperation

of December 19, 1997

The Russian Federation and the Republic of Belarus which are hereinafter referred to as with the Parties

confirming the commitment to the purposes and the principles of Articles of organization of the United Nations, the Helsinki Final act, the Parisian charter for new Europe, other documents of Organization for Security and Cooperation in Europe,

proceeding from need of protection of national interests of the Russian Federation and the Republic of Belarus for the military sphere,

aiming to approve the foreign policy, common positions on the main international issues, to interact in safety of both states, coordinating the interstate activities within joint defense policy,

being guided by provisions of the Agreement on the Union of Belarus and Russia of April 2, 1997 and the Charter of the Union of Belarus and Russia of May 23, 1997,

in view of that the Contract between the Russian Federation and the Republic of Belarus on coordination of activities in military area of July 20, 1992 was expected transition period - time of creation of own Armed Forces of the Russian Federation and the Republic of Belarus, its basic provisions are realized, and some of them require adjustment in connection with the last changes in relations between both states,

agreed as follows:

Article 1

The military cooperation between the Russian Federation and the Republic of Belarus is performed for the purpose of safety of both states and is based on the following principles:

respect for rules of international law and the international obligations of the Parties, accomplishment of provisions of earlier signed agreements in the field of military cooperation;

sovereignty of both states, equality and mutual advantage;

ensuring collateral actions of the Parties on the armed protection of Russia and Belarus;

compliance of construction and development of Armed Forces of both states to the purposes and tasks of the joint armed protection.

Article 2

The parties perform military cooperation in the following main directions:

defense policy and strategy;

rapprochement and standardization of the legislation in the field of defense, military construction and social protection of the military personnel;

development of the state defense order, general programs of arms, production and repair of military equipment;

creation of regional grouping (forces), planning of its application, operational and material security;

unification of management system of regional grouping (forces);

content and use of military facilities of both states according to economic opportunities of the Parties and taking into account military-political situation;

preparation of military personnel;

preparation of reserves and creation of material inventories.

Article 3

The parties realize the main directions of military cooperation in the following forms:

official visits and working meetings at the level of management of the Ministries of Defence or other representatives of Ministers of Defence of representatives;

joint actions for training of armed forces of the Parties, including operational, mobilization and combat training;

joint development and arms production and military equipment;

joint military scientific research, including on creation of the latest military technologies, and also optimization of system of military science of the Parties;

training of the military personnel in military schools of the Parties on equal terms, joint preparation military and scientific and research and educational personnel;

exchange military and scientific, military and technical and military legal information;

holding cultural and sporting events within military cooperation;

other forms according to the mutual arrangement.

Article 4

The parties will make efforts for determination of the new directions and enhancement of forms of cooperation.

Realization and development of the main directions of cooperation in military area are performed by decision path the Supreme Council and Executive Committee of the Union of Belarus and Russia according to their competence.

The separate directions of military cooperation of the Party perform by the conclusion of bilateral agreements.

Regulatory legal acts of the Union of Belarus and Russia and prisoners Agreement parties are equally obligatory for both states.

Article 5

On the basis of this Agreement the Ministries of Defence of the Russian Federation and the Republic of Belarus annually develop the plan of military cooperation.

The plan of military cooperation includes names of actions and tasks, form of their implementation, time and the place of accomplishment, responsible bodies, sources of financing and other questions.

Article 6

The Parties perform the financial expenses connected with implementation of actions in the field of military cooperation on the basis of reciprocity.

Financing of joint programs and actions for implementation of this agreement is performed through the bodies authorized by the Parties or through Executive Committee of the Union of Belarus and Russia.

Article 7

For the purpose of implementation of this agreement authorized bodies of the Parties in accordance with the established procedure can communicate, including containing the state secrets (the state secrets). The parties shall ensure safety of information obtained within military cooperation and observe the approved privacy degree.

Not provide the parties to the third parties, including any legal entities and physical persons, information obtained during bilateral military cooperation without prior written consent of the Party which provided such information.

Article 8

This Agreement is subject to ratification and becomes effective in day of exchange of instruments of ratification.

This Agreement is signed for a period of five years and will be prolonged automatically the next five years if any of the Parties not later than six months before the expiration of the next period does not send the written notice to other Party about the intention to stop its action.

It is made in the city of Minsk on December 19, 1997 in two authentic copies; everyone in the Russian and Belarusian languages, and both texts are equally authoritative.
