realizing regulations of the Agreement between the Russian Federation and the Republic of Byelorussia on creation of equal conditions to subjects of managing and the Protocol to it of December 25, 1998,
aiming to create mutually advantageous conditions for mutual trade and trade with the third countries,
setting the task to provide protection of national interests of the Parties,
being guided by the purposes and the principles of non-proliferation of weapons of mass destruction and rocket means of its delivery,
considering that export control is necessary first of all for ensuring national security of the Russian Federation and the Republic of Byelorussia,
agreed as follows:
The parties will cooperate concerning export control of separate material types, the equipment, technologies and services which can be used in case of development and creation of weapons of mass destruction and rocket means of its delivery, and also other types of arms and military equipment.
The parties will realize this agreement according to the legislation of the states and obligations following from this agreement.
The parties will unify the national legal systems of the states regulating foreign trade activity concerning the separate material types, the equipment, technologies and services which are subject to export control of the Parties and specified in Article 1 of this agreement, being guided by the principle of comprehensive control for the purpose of non-proliferation of weapons of mass destruction and rocket means of its delivery.
The parties will exercise export control, including by licensing and customs control over export, on the basis of the national unified lists of the separate material types, the equipment, technologies and services which are subject to export control of the Parties.
The national unified lists of the separate material types, the equipment, technologies and services which are subject to export control of the Parties and procedure of export control shall correspond to the international treaties and arrangements regulating the international modes of export control irrespective of participation of the Parties in these international modes.
The parties will bring the national unified lists of the separate material types, the equipment, technologies and services which are subject to export control of the Parties to the subjects of managing of any pattern of ownership acting in their territory and will organize export control of foreign trade activity of such subjects from the relevant state bodies.
The parties will pursue coordinated policy in the field of export control, to exchange the relevant information and to hold for this purpose consultations.
According to the mutual arrangement of the Parties changes and additions which are drawn up by separate protocols which will be its integral part can be made to this agreement.
This agreement becomes effective from signature date and will be valid before the expiration of six months from date when one of the Parties in writing notifies other Party on intention to stop its action.
It is made in the city of Minsk on April 13, 1999 in duplicate in Russian, and both texts are equally authoritative.
