Questions of the Ministry of Labour and Social Protection of the Republic of Belarus

Based on paragraphs of the third and fourth of article 25 of the Law of the Republic of Belarus of July 23, 2008 "About Council of Ministers of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 424-Z

1. Create department of State Labour Inspection in structure of the Ministry of Labour and Social Protection, having given to him with the consent of the President of the Republic of Belarus the rights of the legal entity.

2. Approve Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus it (is applied).

3. Consider necessary to have in the Ministry of Labour and Social Protection of the Republic of Belarus board in number of 17 people.

4. Recognize invalid decisions of the Government of the Republic of Belarus according to the enclosed list.

5. To the Ministry of Labour and Social Protection of the Republic of Belarus in three-months time to take measures on:

to reduction of regulatory legal acts in compliance with this resolution;

optimizations of system of the organizations subordinated to the Ministry.

Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus

1. The Ministry of Labour and Social Protection of the Republic of Belarus (further – Ministry of Labor and social security) is the republican state body pursuing state policy, exercising control in the field of work and labor protection, employment of the population, social protection, demographic safety, alternative service, coordinating activities for these directions of other republican state bodies, and also performing organizational and technical and information support of activities of Republican interdepartmental council by the rights of disabled people, National committee on the population under Council of Ministers of the Republic of Belarus and National council on gender policy under Council of Ministers of the Republic of Belarus.

2. Ministry of Labor and social security in the activities is guided by the Constitution of the Republic of Belarus, other acts of the legislation, including this Provision.

3. The structure of central office of Ministry of Labor and social security includes head departments, managements, departments, sectors, departments with the rights of the legal entity: Department of State Labour Inspection (further – Department) and Social Security Fund of the population of Ministry of Labor and social security (further – Fund).

In central office of Ministry of Labor and social security for the purpose of ensuring its activities and maintenance other structural divisions can be created.

4. The system of Ministry of Labor and social security includes structural divisions regional and Minsk city executive committees, the performing state powers of authority in the field of work, employment and social protection, territorial authorities of Department and Fund in quantity according to appendix, the organization, subordinates of Ministry of Labor and social security, according to the list established by Council of Ministers of the Republic of Belarus.

5. The main objectives of Ministry of Labor and social security are:

development of offers and realization of the main directions and priorities of state policy concerning assistance of employment of the population, payment, conditions and labor protection, the national social insurance and provision of pensions, demographic safety, social partnership, settlement of collective employment disputes, social servicing and the public assistance, alternative service, improvement of social and economic conditions of activity of family, providing the equal rights and equal opportunities of men and women, social guarantees to the population;

enhancement of the legislation on work, employment and social protection of the population, about guardianship and custody concerning full age persons who are recognized as incapacitated or is limited capable, about licensing in the field of social servicing;

control of compliance with law about the national social insurance, supervision of compliance with law about work and about labor protection;

implementation of international cooperation in these spheres of activity.

6. Ministry of Labor and social security according to the tasks assigned to it and within competence:

6.1. develops with participation of the interested republican state bodies of the offer on the main directions and priorities of state policy in the field of work, conditions and labor protection, assistance of employment, demographic safety and social protection, social protection and alternative service;

6.2. represents to Council of Ministers of the Republic of Belarus reports on work, conditions and labor protection, assistance of employment, demographic safety, social protection and offer to state programs (forecasts) of social and economic development of the Republic of Belarus for the long-term, medium and short-term outlook;

6.3. participates in development, will organize accomplishment of social programs and exercises control of their realization;

6.4. will organize and carries out monitoring in the field of work, including contractual form of hiring of workers, assistance of employment, demographic safety and social protection;

6.4-1. makes in accordance with the established procedure offers on acceptance of additional measures for prevention of violations of labor rights of the workers working under the contract;

6.5. makes in accordance with the established procedure offers on the state minimum social standards in the field of work, provision of pensions, social support and social servicing;

6.5-1. establishes in coordination with the Ministry of Health of regulation of food, and also determines procedure for catering services of citizens, including dietary, for suppliers of the social services performing stationary social servicing, the sanatoria subordinated to the Ministry of Labour and Social Protection;
