The agreement between the Government of the Russian Federation and the Government of the Republic of Byelorussia on approval of inventories to which quantitative restrictions, prohibitions or restrictions are applied

The government of the Russian Federation and the Government of the Republic of Byelorussia which are hereinafter referred to as by the Parties

realizing regulations of the Agreement between the Russian Federation and the Republic of Byelorussia on creation of equal conditions to subjects of managing of December 25, 1998 and the Protocol to it, for the purpose of implementation of single measures of non-tariff regulation of foreign trade in goods,

agreed as follows:

Article 1

The parties will apply according to the national legal system of the states: the inventory to which quantitative restrictions when exporting and/or importing (appendix 1) are applied; the inventory to which prohibitions or import restrictions and/or export (appendix 2) are applied.

Goods which export is limited to the Parties because of introduction against them anti-dumping restrictions in the markets of the third countries do not fall under action of this agreement.

Article 2

The parties are regularly prepared and brought in Executive committee of the Union of Belarus and Russia for approval of the offer:

on harmonization and standardization of legislations in the field of non-tariff measures of regulation of foreign trade in goods;

on development of the unified lists and nomenclatures of goods to which quantitative restrictions, prohibitions or import restrictions and/or export are applied.

Article 3

The parties can make the approved changes and additions to the lists specified in Article 1, after carrying out mutual consultations.

Article 4

Disputes and disagreements in case of interpretation and application of this agreement will be solved the Parties by negotiations and consultations.

Article 5

By mutual consent of the Parties changes and additions which are drawn up by protocols which will be its integral part can be made to this agreement.

Article 6

This agreement becomes effective from signature date and will remain in force before the expiration of six months from the date of the written notice of one of the Parties of intention to stop its action.

It is made in Moscow on February 12, 1999 in two authentic copies in Russian.

Appendix № 1

Note: Concerning the goods specified in this list, the Parties establish procedure for the omission of loads through customs border only according to licenses of the country introducing quantitative restrictions when exporting and/or importing.

The printed and audiovisual materials, other data carriers containing data which can do harm to political, economic interests of the Republic of Byelorussia, its state security, health protection and morality of citizens
