the Agreements on the Union of Belarus and Russia interested in practical realization, signed on April 2, 1997 in Moscow, and the Agreement on mutual ensuring safety of interstate secrets signed on January 22, 1993 in Minsk

recognizing need of combination of their efforts in the field of information security,

agreed as follows:

Article 1

The terms used in this agreement mean the following:

"information security" - the activities directed to prevention of leakage of confidential information, unauthorized and inadvertent impacts on confidential information;

"confidential information" - information on which distribution according to the legislation of the states of the Parties restrictions are imposed and for the purposes of which protection necessary measures are taken;

"means of information protection" - the means intended for information security, means in which they are realized, and also control facilities of efficiency of information security.

Article 2

The parties perform cooperation in the field of protection of confidential information which leakage can cause damage to the vital interests of the states of the Parties.

The relations in the field of safety and operation of means of cryptographic information security, and also in the field of identification of electronic and program mortgage devices are regulated by the separate international treaties prepared by the relevant competent authorities.

Article 3

Each Party according to the national legal system of its state and this agreement takes the measures aimed at providing protection of the confidential information transferred to it by other Party.

If other is not provided by supplementary agreements, in the relations between the Russian Federation and the Republic of Byelorussia are applied the provision of this agreement and the Agreement on mutual ensuring safety of interstate secrets signed on January 22, 1993 in Minsk.

The parties not transfer confidential information without written consent the Parties from which it is received to any third party, including foreign states, their citizens and legal entities.

Article 4

For the purpose of implementation of this agreement of the Party exchange work experience concerning information security, if necessary hold consultations and create joint working groups which results of activities are drawn up in the form of separate protocols.

Article 5

The parties cooperate in the following areas:

development of the legal acts governing the relations in the field of information security;

development and use of normative and methodical documents in the field of information security;

coordination of actions for ensuring information security in the course of interstate interaction;

development and use of means of information protection;

development and implementation of interstate scientific and technical programs in the field of information security;

preparation and advanced training of specialists in information security.

Article 6

Each of the Parties recognizes education documents and qualifications of specialists in the field of information security, about assignment of academic degrees and ranks on these questions, issued according to the legislation of other Party.

Article 7

The parties cooperate in questions of creation, development and harmonization of national systems of standardization, licensing, certification and insurance in the field of information security, perform exchange of information in this area.

Article 8

Financing of the events held within this agreement is performed by the Parties according to the procedure and on the conditions approved by them on each action.

Article 9

In case of disputes over interpretation or application of provisions of this agreement of the Party will resolve them by negotiations.

Article 10

This agreement becomes effective from the date of its signing and will stop the action in 6 months after receipt of one of the Parties of the written notice of other Party of its intention to terminate the Agreement.

It is made on July 9, 1997 in the city of Moscow in duplicate, everyone in the Russian and Belarusian languages, and both texts are equally authoritative.
