On single non-tariff regulation of custom union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation

Interstate Council of Eurasian economic community (the supreme body of custom union) at the level of heads of states solved:

1. According to the Protocol on procedure for entry into force of the international treaties directed to forming of the contractual legal base of custom union, exit from them and accessions to them of October 6, 2007 to consider become effective since January 1, 2010:

The agreement on single measures of non-tariff regulation concerning the third countries of January 25, 2008;

The agreement on procedure for introduction and application of the measures affecting foreign trade in goods on single customs area concerning the third countries of June 9, 2009;

The agreement on rules of licensing in the field of foreign trade in goods of June 9, 2009.

2. Ceased to be valid according to the Decision of the Supreme Eurasian economic council of 19.12.2012 No. 24

3. Transfer the Commissions of custom union of power provided by the international treaties specified in Item 1 of this Decision from the date of this Decision.

4. The commissions of custom union till June 1, 2010 to approve single form of the conclusion (the allowing document) provided by the regulations on application of restrictions specified in Item 2 of this Decision.

5. The commissions of custom union till July 1, 2010 to consider the bases for introduction of quantitative restrictions, except exclusive right, provided by the single inventory to which prohibitions or import restrictions or export by the State Parties of custom union within Eurasian economic community in trade with the third countries are applied, applied in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation unilaterally and to provide their cancellation or introduction concerning such goods of single measures of regulation on customs area of custom union.

6. Determine that the prohibitions and restrictions in trade in goods with the third countries directed to accomplishment of the obligations connected with introduction of special protective, anti-dumping and countervailing measures or conducting the corresponding investigations and also to realization of response measures are applied in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation according to the national legal system.

7. No later than July 1, 2010 to provide to the Republic of Kazakhstan realization of the Regulations on procedure for import to customs area of custom union and export from customs area of custom union of the precious metals, gemstones, the primary goods containing precious metals coming from the Republic of Kazakhstan.

8. Determine that before accession of custom union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation as regional economic integration organization to the International scheme of certification of the rough natural diamonds, movement of diamonds (the FEACN CU codes 7102 10 000 0 (only import), 7102 21 000 0, 7102 31 000 0) through frontiers of the State Parties of custom union in the territory of custom union it is performed taking into account requirements

9. The Republic of Belarus, the Republic of Kazakhstan, the Russian Federation do not apply licensing and quantitative restrictions in mutual trade, except for white sugar (the FEACN CU codes 1701 99 100 and 1701 99 900), delivered till April 1, 2010 from the Republic of Belarus and the Russian Federation to the Republic of Kazakhstan.

10. Till July 1, 2010 to provide to the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation modification of regulatory legal acts of heads of state and government of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation and of legal acts of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation in connection with entry into force of the international treaties specified in Item 1 of this Decision, and transfer of the Commission of custom union of the powers determined by them.

11. To provide to the governments of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation publication of this Decision, and also decision of the Commission of custom union on single non-tariff regulation of custom union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation in official publications according to the legislation of the State Parties of custom union.
