Approve the enclosed Regulations on procedure of production of underground waters for own production and technology needs as the subsoil users performing exploration and production of minerals or according to the combined license geological studying, exploration and production of minerals in borders of the mountain branches and (or) geological branches provided to them based on the approved engineering design.

1. This Provision is developed according to article 19.1 of the Law of the Russian Federation of February 21, 1992 N 2395-I "About subsoil" (Sheets of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1992, N 16, Art. 834; Russian Federation Code, 1995, N 10, Art. 823; 1999, N 7, Art. 879; 2000, N 2, Art. 141; 2001, N 21, Art. 2061; N 33, of Art. 3429; 2002, N 22, Art. 2026; 2003, N 23, Art. 2174; 2004, N 35, Art. 3607; 2006, N 17, Art. 1778; N 44, of Art. 4538; 2007, N 27, Art. 3213; N 49, of Art. 6056; 2008, N 18, Art. 1941; N 29, of the Art. 3418, 3420; 2008, N 30, Art. 3616; 2009, N 1, the Art. 17), the Regulations on the Ministry of Natural Resources and Environmental Protection of the Russian Federation approved by the order of the Government of the Russian Federation of May 29, 2008 N 404 (The Russian Federation Code, 2008, N 22, Art. 2581; N 42, of Art. 4825; N 46, of Art. 5337; 2009, N 3, Art. 378; N 6, of the Art. 738), also establishes procedure for production of underground waters for own production and technology needs the subsoil users performing exploration and production of minerals or according to the combined license geological studying, exploration and production of minerals in borders of the mountain branches and (or) geological branches provided to them based on the approved engineering design.

2. According to part 2 of article 19.1 of the Law of the Russian Federation "About subsoil" the subsoil users performing exploration and production of minerals or according to the combined license geological studying, exploration and production of minerals in borders of the mountain branches and (or) geological branches provided to them have the right based on the approved engineering design for own production and technology needs to perform production of underground waters according to the procedure, established by federal body of management of the state fund of subsoil.

3. The basis for implementation of mineral right for the purpose of production of underground waters for own production and technology needs is availability at the subsoil user of the license for mineral right for the purpose of exploration and production of minerals or the combined license for the purpose of geological studying, exploration and production of the minerals provided to it mountain branch and (or) geological branch and the approved engineering design for production of underground waters.

4. The engineering design on production of underground waters is developed, approved and affirms in accordance with the established procedure.

5. Production of underground waters by the subsoil user for own production and technology needs is performed after registration in territorial geological fund (TFI) of the completed accounting card of borehole for water (appendix N 1) which copy is stored in licensed case.

The procedure for filling of accounting cards of boreholes is given in the appendix N 2 to this Provision.
