Rules of accreditation of the citizens and the organizations involved by state control (supervision) bodies and bodies of municipal control in holding actions for control

1. These rules establish procedure for accreditation of the citizens and the organizations involved by state control (supervision) bodies and bodies of municipal control as experts, the expert organizations in holding actions for control when implementing by the specified bodies of checks of legal entities and individual entrepreneurs (further - accreditation).

2. Accreditation is performed by the federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies authorized on carrying out according to the state control (supervision), municipal control (further - accreditation bodies), for the purpose of recognition of competence of citizens and the organizations in the respective sphere of science, the equipment and economic activity for participation in holding actions for control. Accreditation is performed on the declared types of activity.

3. Accreditation bodies perform:

a) consideration of the application about provision of the certificate on accreditation and provision of the certificate on accreditation;

b) renewal of the certificate on accreditation and prolongation of term of its action;

c) suspension, renewal and cancellation of the certificate on accreditation;

d) cancellation of the certificate on accreditation;

e) maintaining the register of the granted certificates on accreditation (further the register);

e) provision of information on accreditation.

4. The citizen, the organization in case of the appeal to accreditation body with the statement for provision of the certificate on accreditation (daleezayavitel) shall meet the following requirements of accreditation:

a) have available being in property or on other legal cause of the room, construction, the devices, other equipment and equipment necessary for performance of works on holding actions for control and meeting the requirements established in accordance with the legislation of the Russian Federation - for the organization;

b) have in the state at least 5 specialists having average professional and (or) higher education, and also length of service on the declared types of activity at least 5 years - for the organization;

c) have average professional and (or) higher education, and also length of service on the declared types of activity at least 5 years - for the citizen;

d) have copies of regulatory legal acts, regulating, technical and methodical documents regulating questions of the organization and holding actions for control in the respective sphere of the state control (supervision), municipal control;

e) not consist in civil and employment relationships with legal entities and individual entrepreneurs concerning whom are performed and not to be the affiliate of the checked faces.

5. For receipt of the certificate on accreditation the applicant represents to accreditation body directly or directs the mailing with the assurance of receipt the following documents:

a) the statement for provision of the certificate on accreditation in form according to the appendix N 1;

b) copies of constituent documents (with submission of originals if fidelity of copies is not notarized) - for the organization;

c) ceased to be valid according to the Order of the Government of the Russian Federation of 15.12.2012 No. 1310

d) copies of the documents confirming availability at the applicant of the rooms, constructions, devices, other equipment and equipment which are at it in property or on other legal cause necessary for performance of works on holding actions for control - for the organization;

e) copies of the documents confirming availability in staff of the applicant of specialists, the level of professional education and which length of service meet the requirements established by the subitem "b" of item 4 of these rules (the copy of the staff list, the order on employment, service records, education documents), - for the organization;

e) copies of the documents confirming compliance of level of professional education and length of service to the requirements established by the subitem "v" of item 4 of these rules (the copy of the service record, employment contracts, agreements on accomplishment by the citizen of works (services) in the declared types of activity for the last 3 years, education documents), - for the citizen;

g) the list of the documents regulating questions of the organization and holding actions for control in the respective sphere of the state control (supervision), municipal control - for the organization.

6. The application for provision of the certificate on accreditation is signed by the citizen, the head of the organization or person representing the organization and certified it by seal.

7. The accreditation body has no right to demand from the applicant of submission of documents, not stipulated in Item 5 these rules.

8. The documents submitted (directed) by the applicant according to Item 5 of these rules (further - documents) are accepted according to the inventory and are registered accreditation body in day of their receipt.

The accreditation body within 3 working days from the date of receipt of documents directs (hands) to the applicant the notification on acceptance to consideration of documents or on need of elimination by the applicant of the allowed violations for execution of the statement for provision of the certificate on accreditation and (or) submission of missing documents.

The accreditation body within 2 working days from the date of receipt of documents requests, including electronically with use of single system of interdepartmental electronic interaction, in the Federal Tax Service (its territorial authorities) of the information about the applicant from the Unified State Register of Legal Entities (for the organization), and also about statement of the applicant on tax accounting.
