THE ORDER OF STATE COMMISSION OF UKRAINE ON INVENTORIES OF MINERALS UNDER THE MINISTRY OF PROTECTION OF THE SURROUNDING ENVIRONMENT OF UKRAINE

of October 6, 2009 No. 393

About approval of the Instruction for application of Classification of inventories and resources of minerals of the state fund of subsoil to fields of industrial underground waters

According to article 7 of the Law of Ukraine "About the Public geological service of Ukraine", the subitem 16 of item 4 of the Regulations on State commission of Ukraine on inventories of minerals approved by the resolution the Cabinet of Ministers of Ukraine of 10.11.2000 N 1689 (with changes), and Item 7 of the Classification of inventories and resources of minerals of the state fund of subsoil approved by the resolution of the Cabinet of Ministers of Ukraine of 05.05.97 N 432 (with changes), for the purpose of establishment of single requirements to geological studying, geological economic evaluation of fields of industrial underground waters and conditions of determination of their readiness to industrial development I ORDER:

1. Approve the Instruction for application of Classification of inventories and resources of minerals of the state fund of subsoil to fields of industrial underground waters which is attached.

2. Recognize not applied in the territory of Ukraine, the "Instruction for application of Classification of operational inventories of underground waters to fields of industrial waters" approved by the chairman of the State Commission on Mineral Reserves under Council of Ministers of the USSR 06.06.84.

3. To submit to department of underground waters, hydromineral raw materials and therapeutic muds (Bakarzhiyev O. O.) this order on state registration to the Ministry of Justice of Ukraine in accordance with the established procedure.

4. I reserve control over the implementation of the order.

5. This order becomes effective from the date of its official publication.

The instruction for application of Classification of inventories and resources of minerals of the state fund of subsoil to fields of industrial underground waters

I. General provisions

1.1. This Instruction establishes requirements to geological studying of fields (sites of fields) of industrial waters according to complexity of their geological structure, the requirement to calculation, geological economic evaluation and the state accounting of the operational (extracting) inventories of underground industrial waters according to the level of their industrial value, the conditions determining readiness of certain field (the site of the field) to industrial development, the basic principles of assessment of perspective and forecast resources of industrial underground waters within prospective areas and the territories and subsoil plots.

1.2. Requirements of the Instruction are obligatory for subjects of housekeeping irrespective of the pattern of ownership and subordination performing planning, financing and accomplishment of exploration works on search and investigation of fields of industrial underground waters, designing and construction of water intaking constructions, operation of fields of industrial underground waters.

II. Normative references

The instruction is developed according to the following regulatory legal acts:

The code of Ukraine about subsoil;

Water code of Ukraine;

The classification of inventories and resources of minerals of the state fund of subsoil approved by the resolution of the Cabinet of Ministers of Ukraine of 05.05.97 N 432 (further - Classification of inventories and resources of minerals of the state fund of subsoil);

The regulations on State commission of Ukraine on inventories of minerals approved by the resolution of the Cabinet of Ministers of Ukraine of 10.11.2000 N 1689;

The regulations on procedure for conducting state examination and assessment of inventories of minerals approved by the resolution of the Cabinet of Ministers of Ukraine of 22.12.94 N 865 in edition of the resolution of the Cabinet of Ministers of Ukraine of 04.10.2000 of N 1512) (further - Regulations on procedure for conducting state examination and assessment of inventories of minerals);

The regulations on stages of exploration works on underground waters (hydrogeological works) approved by the order Minekoresursov of Ukraine of 16.07.2001 of N 260, registered in Ministry of Justice of Ukraine 30.07.2001 for N 648/5839 (further - Regulations on stages of exploration works on underground waters (hydrogeological works)).

III. Terms and determinations

The terms and determinations provided in the Instruction are applied in such value:

Industrial underground waters are the underground waters containing useful components in quantities in case of which their withdrawal for further industrial use is economically reasonable.

The field of industrial underground waters is water object in subsoil with the counted operational inventories and spatially certain borders in which favorable conditions for production and use of industrial waters were formed.

The site of the field of industrial underground waters is spatially the limited part of the field of industrial underground waters with the counted operational inventories allocated on geological and structural, hydrogeological conditions, structure and content of useful components in water or under the terms of arrangement of water intaking constructions and to other signs within which there are favorable conditions for production of industrial waters separate water intake.

Operational inventories of industrial waters are the amount of industrial waters counted according to geological studying of fields (sites) which can be extracted from subsoil by water intakes, rational on technical and economic indicators, in the set operation mode on condition of compliance of quality characteristics of these waters to requirements of the established standards and admissible level of environmental impact throughout the settlement term of water use.

Resources of industrial underground waters (hereinafter understand perspective and forecast resources as resources) - the amounts of industrial underground waters estimated according to geological studying of subsoil characterizing potential opportunities of their production from subsoil in the corresponding territory.

IV. General information concerning geological economic evaluation of fields of industrial underground waters

4.1. On the current state from underground waters in industrial scale iod, bromine, lithium, boron, rubidium, potassium, magnesium, kitchen salt, sodium sulfates, potassium sulfates and other components are withdrawn.
