The agreement on single approaches to use of information technologies in activities of Customs Services of state members of Eurasian economic community

The governments of state members of Eurasian economic community (EurAsEC) which are hereinafter referred to as with the Parties

being guided by the Agreement on the Customs union and the Common economic space of February 26, 1999 and the Constitutive treaty of Eurasian economic community of October 10, 2000,

aiming at ensuring effective customs control over the goods and vehicles moved through frontiers of the states of the Parties

wishing to promote the equal competition, macroeconomic stability and ensuring the approved tax, monetary, monetary and customs policy in Eurasian economic community,

intending to accelerate and simplify movement of goods and vehicles through the territories of state members of Eurasian economic community, to ensure safety of transportations of goods and vehicles and protection of economic interests of the states of the Parties, and also to prevent illegal movement of goods and vehicles,

agreed as follows:

Article 1

In this agreement terms are used in the following determinations:

"the automated system" - the system consisting of personnel and complex of the automation equipment of activities of the specified personnel, realizing information technology of accomplishment of the established functions;

"information security" - acceptance of legal, organizational and technical (program and technical) measures for the purpose of ensuring integrity and safety of information, non-admission of its unauthorized change or destruction, maintaining confidentiality of information of limited access, realization of the right to information access, and also non-admissions of unauthorized impact at the expense of processing, transfers and storages of information;

"information" - the information about persons, objects, facts, events, the phenomena and processes, irrespective of form of their representation;

"information resource" - set of the documentary information (the database, other arrays of information) containing in information systems;

"information system" - set of information containing in databases and information technologies and technical means providing its processing;

"information technologies" - processes, methods of search, collection, storage, processing, provision, distribution of information and methods of implementation of such processes and methods;

"information and telecommunication network" - the technological system intended for transfer on information communication lines, access to which is provided with use of computer aids;

"certification center" - the legal entity performing functions on management of signature key certificates and provision of other services according to the legislation of the state of each of the Parties.

Article 2

The purpose of this agreement is development of single approaches to use of information technologies in activities of Customs Services of the states of the Parties for increase in efficiency of accomplishment of the following tasks:

ensuring information openness and transparency of mechanisms of customs clearance and customs control in case of proper information security;

reducing time of customs clearance and customs control;

creation of conditions for simplification of procedures of customs control on frontiers of the states of the Parties, and also for the organization of joint customs control at check points through frontiers of the states of the Parties;

integration of information resources of Customs Services of the states of the Parties on the basis of information exchange;

ensuring information compatibility of the automated systems of Customs Services of the states of the Parties;

increase in efficiency of information exchange between Customs Services of the states of the Parties.

Article 3

For development of single approaches to use of information technologies Customs Services of the states of the Parties jointly solve the following problems:

preparation of suggestions for improvement of the legislation of the state of each of the Parties and international treaties within Eurasian economic community in the field of use of information technologies by Customs Services of the states of the Parties taking into account the international practice;

development of procedure for forming and use of information resources of Customs Services and requirements to documentation of information containing in the information resources which are under authority of Customs Services of the states of the Parties;

development of the integrated information and telecommunication network providing effective information exchange of Customs Services of the states of the Parties taking into account functioning of certification centers;

development of procedure and conditions of use for the customs purposes of information systems, information technologies and means of their providing;

forming of the unified classification system and coding of information necessary for implementation of information exchange of Customs Services of the states of the Parties;

ensuring information security of activities of Customs Services of the states of the Parties;

coordination of works and carrying out consultations on creation of new information systems for Customs Services of the states of the Parties.

Article 4

Customs Services of the states of the Parties perform exchange of information within the competence and according to the legislation of the state of each of the Parties.

Article 5

For ensuring access to information on questions of customs regulation at the interstate level and its joint use in case of the solution of the tasks facing Customs Services of the states of the Parties, the Parties hold events for integration of information resources and determination of the authorized persons having to them the regulated access.

Article 6

The integrated information and telecommunication network of Customs Services of the states of the Parties is intended for:

uses of the states of the Parties of Customs Services of complex of modern telecommunication services;

unification of the technical solutions used in case of information exchange of Customs Services of the states of the Parties;

ensuring connection of information and telecommunication networks for the purpose of high-quality and reliable information transfer between Customs Services of the states of the Parties;

provisions to Customs Service of the state of each of the Parties of access to information resources of Customs Services of the states of other Parties.

Article 7

The procedure for information exchange of Customs Services of the states of the Parties and recognition of legal force of electronic documents by the Parties are determined by the free standing agreement of the Parties.

Article 8

The parties provide confidentiality of information obtained according to this agreement.
