About approval of Rules of reference of buildings and constructions to technically difficult objects and modification of the order of the Government of the Republic of Kazakhstan of August 19, 2002 No. 918

According to the laws of the Republic of Kazakhstan of July 10, 2009 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning respect for the water preserving and nature protection discipline in case of town-planning planning, parcellation, designing and construction" and of July 16, 2001 "About architectural, town-planning also you build activities in the Republic of Kazakhstan" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of reference of buildings and constructions to technically difficult objects.

2. Bring in the order of the Government of the Republic of Kazakhstan of August 19, 2002 No. 918 "About Rules of conducting examination preproject (feasibility statements) and project (project and estimate) documentation on construction irrespective of financing sources, and also approvals of the projects which are under construction due to the state investments" (SAPP of the Republic of Kazakhstan, 2002, No. 27, the Art. 304) the following change:

Rules of conducting examination preproject (feasibility statements) and project (project and estimate) documentation on construction irrespective of financing sources and also to be reworded as follows the approvals of the projects which are under construction due to the state investments, approved by the specified resolution according to appendix to this resolution.

3. This resolution becomes effective from the date of the first official publication.

Rules of reference of buildings and constructions to technically difficult objects

1. These rules of reference of buildings and constructions to technically difficult objects (further - Rules) establish general procedure for reference of buildings and constructions to technically difficult objects and are management when carrying out preproject procedures, designing, conducting examination and approval of projects, and also their sale (construction).

2. Rules are developed according to the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan", and also the state (interstate) standard rates in the field of architecture, town planning and construction.

3. Technical complexity of construction object is determined depending on its level of responsibility by degree of technical requirements to reliability and durability of the bases and building constructions which are established by the state (interstate) standard rates determining basic provisions by calculations, loadings and impacts.

4. The level of responsibility (the first - increased, vtoroynormalny or third - lowered) planned to asset construction is established by developer of the project (general designer) in design process depending on set:

1) functional purpose of object;

2) features of its bearing and protecting designs;

3) number of floors (constructive tiers);

4) seismic danger or other special conditions of the site;

5) other external impacts (wind or snow loads and so forth).

The established level of responsibility is fixed in project materials as technical characteristic of the building or construction.

5. All buildings and constructions first (raised) and the second (normal) production purpose of levels of responsibility, including production and economic constructions, including, the separate warehouses and storages requiring special conditions for storage of goods or materials, and also other special project decisions and actions in case of the construction and operation aimed at providing fire and explosion safety, special conditions on maintenance of certain level of aeration, humidity, temperature condition, restriction of vibration and other special requirements belong to technically difficult objects (complexes).

All structures of the third (lowered) level of responsibility, including, mobile complexes of container and block execution do not belong to technically difficult subjects to production assignment (including production and economic constructions).

6. All buildings and constructions of the first (increased) level of responsibility, and also the building and construction of the second (normal) level of responsibility, except for objects, stipulated in Item 7 these rules belong to technically difficult subjects (complexes) to construction engineering assignment.

7. The following buildings and constructions of the second (normal) level of responsibility do not belong to technically difficult subjects (complexes) to construction engineering assignment:

1) apartment houses no more than 3 land floors high, except for under construction in regions (zones) of the increased seismic danger or others special geological (hydrogeological) and the geospecifications requiring special project solutions and actions;

2) public buildings and constructions no more than 2 land floors high, with simultaneous stay in internal rooms no more than 50 people, including visitors (the audience, clients, patients, passengers, buyers living in hotels and so forth), and also the employees and personnel servicing them;

3) separate one-storey Items of car service with simultaneous servicing no more than 10 units of vehicles, and also elevated or underground garages parking, with a capacity no more than 15 cars.

All structures of the third (lowered) level of responsibility, including mobile complexes of container and block execution, and also built from collapsible designs also do not belong to technically difficult objects.
