Conditions under which real estate is recognized equivalent to earlier being available real estate

Real estate, rights of possession and (or) uses on which are granted instead of real estate, rights of possession and (or) uses, concerning which stop in connection with demolition or with reconstruction of the building, structure, construction which or part of which such real estate is, or in connection with provision of the rights to such real estate state or to municipal educational institutions, medical institutions, is recognized equivalent to earlier being available real estate in case of simultaneous observance of the following conditions:

1) in the location:

the provided real estate is in borders of the same rural settlement, settlement, the intracity territory of the federal city, area (in case of division of the city into areas), the cities without district division where there is earlier available real estate;

2) on the area:

total area of the provided real estate does not exceed more than for twenty percent total area of earlier available real estate, and at the same time total area of the provided real estate does not exceed total area of earlier available real estate more than on hundred square meters, and cannot be reduced more than by twenty percent from earlier available real estate;

3) on determined in accordance with the legislation of the Russian Federation, regulating estimative activities, costs:
