Chapter 1. General provisions

Article 1. Subject of regulation of the Law

This Law establishes the legal basis of implementation of activities in the field of mail service in the territory of the Republic of Armenia, the powers of state bodies directed to regulation of activities of mail service, and also right and obligation of the physical persons and legal entities using services of mail service and express communication.

The relations in the field of the state express communication are not governed by this Law.

Article 2. Legal regulation of the relations in the field of mail service

In the Republic of Armenia the relations in the field of mail service are governed by the Civil code of the Republic of Armenia, this Law, other laws and other legal acts.

If international treaties establish other regulations than provided by this Law, then regulations of international treaties are applied.

Article 3. The basic concepts used in the Law

1. In this Law the following basic concepts are used:

1) mail service – the communication type providing acceptance, processing, transportation and delivery of the mailing which is single production and technological complex technical and vehicles;

2) services of mail service – action or activities for acceptance, processing, transportation and delivery of the mailing, hybrid departure;

3) services of intra republican mail service – service of mail service in case of which the mailing is accepted, processed and handed in the territory of the Republic of Armenia;

4) services of the international mail service – service of mail service in case of which the mailing is delivered outside the territory of the Republic of Armenia it turns out from other countries and it is delivered to the territory of the Republic of Armenia, or goes on the territory of the Republic of Armenia as transit goods;

5) universal services of mail service – rendering the minimum circle of services of mail service on permanent basis, available to all users, irrespective of the place of their stay in the Republic of Armenia, according to the criteria of quality established by part 1 of article 3.3 of this Law;

6) the mailing – the departure addressed in final form which is taken by person rendering services to mail service according to requirements of regulations, including correspondence, and also books, catalogs, newspapers, periodicals and postal parcels which can have or not have commercial value. Departure is considered addressed in final type if at this departure or its packaging or envelope there is state sign of post payment or other sign recognized by person rendering services to mail service, equivalent to the state sign of post payment and at this departure or its packaging or envelope there is necessary specifying about the receiver's address for its processing by person rendering post services for the purpose of delivery;

7) the simple mailing – not registered mailing in case of which acceptance the sender is not given the receipt and which is handed to the receiver without list;

8) the registered mailing – the mailing which is accepted with delivery of the receipt to the sender and is handed to the receiver (legal representative) under list in the presence of the identity document;

9) the estimated mailing – the mailing which is accepted with assessment by the sender of cost of investment with delivery to the sender of the receipt and is handed to the receiver under list. Maximum amount of the estimated cost identifies person rendering services to mail service;

10) written correspondence – written correspondence on any physical carrier which is transported and handed by the sender to the address specified on this departure or its packaging or envelope. Correspondence includes the simple and registered letters, post cards, sekogramma, packets and small packets, printing objects, such as the direct mailing. Books, to the catalog, periodicals: newspapers and magazines – are not considered as written correspondence;

11) the direct mailing – the mailing type containing promotional, information or public materials. The investment of the direct mailing includes the uniform message or information which cannot change sense of the data transferred by the delivered materials, except for the data including the name, the address, identification number of the addressee and other data concerning addressing;

12) postal parcel – the departure having or not having commercial value, the sizes, weight and which packaging are established by regulations;

13) sekogramma – the mailing intended only for blind people which is handed in open form, in the form of the written messages and editions written by sekografichesky method, cliche with signs of sekografiya, audio recordings, typhlo-technical means;

14) services of express communication – the type of activity of the mail service provided by one legal entity or the individual entrepreneur in case of whom the mailing on orders of the sender gathers in the place of his residence of stay or activities and is delivered to the addressee specified by the sender. During the entire period from acceptance before delivery departure is followed by the courier of this legal entity or the individual entrepreneur without implementation of actions for processing, exchange or transfer;
