About the electronic document and the electronic digital signature

Chapter 1. General provisions

Article 1. Subject of regulation of the Law

1. This Law governs the relations arising in case of application of electronic documents and electronic digital signatures.

2. This Law does not govern the relations connected with use of electronic conversions and analogs of the sign manual of person, and also signed in case of their means of documents.

Article 2. The basic concepts used in this Law

In this Law the following basic concepts are used:

the electronic document - the data registered by electronic method on the material carrier, ratified by the electronic digital signature. The electronic document is created, processed and stored with use of technical means of information systems and information technologies;;

the electronic digital signature - the unique string received by means of cryptographic information transform and provided in electronic and digital form for creation of data of the electronic digital signature and this electronic document which is attached to electronic documents or is logically connected with them and is used for identification of the signing person, and also for protection of the electronic document against counterfeits and misstatements;

person signing the electronic document (further - the signing person), - physical person addressed to which (or on the person which it represents) the certificate of the electronic digital signature is issued;

this for creation of the electronic digital signature - specific string which the signing person uses in case of each application of the electronic digital signature;

these verifications of the electronic digital signature (further - these checks) - specific string which is used for confirmation of authenticity of each electronic digital signature;

tools for the electronic digital signature - equipment rooms and/or software which are applied for the purpose of creation of the electronic digital signature of person, using data for creation of the electronic digital signature;

means of verification of the electronic digital signature - the equipment rooms and/or software creating verifiability of authenticity of the electronic digital signature, using these verifications of the electronic digital signature;

the name of tools for the electronic digital signature - the commercial name of tools for the electronic digital signature;

authenticity of the electronic digital signature - the positive result of data application and means of verification of the electronic digital signature identifying the signing person;

the certificate of the electronic digital signature - the document on paper, electronic or other medium which confirms accessory of data of verification of the electronic digital signature and electronic digital signature to the signing person and serves as means of check of authenticity of the electronic digital signature;

certification center - the organization issuing certificates of the electronic digital signature and rendering other services connected with electronic digital signatures;

accreditation - recognition of service quality by the state, rendered by certification center;

accredited certification center - the certification center which obtained accreditation according to the procedure, established by this Law and other legal acts;

information system - system of preparation, delivery, obtaining, storage or other type of hardware-software development of electronic documents;

the electronic medium - the magnetic disk, magnetic tape, laser disk, semiconductor and other material carriers used for registration and storage of information by electronic or other technical means;

the interested person - the person to which the electronic document, or any other person needing identification of the signing person is addressed.

Chapter 2. Electronic document

Article 3. Forms of submission of the electronic document

The electronic document has the internal and external form of representation.

Form of internal submission of the electronic document is the result of registration on the electronic medium of information constituting the electronic document.

Form of external submission of the electronic document is the result of reproduction of the electronic document on the screen of the video device (display), paper or on other physical item, other than the electronic medium, in available to visual review and in form, clear for perception.

Article 4. Legal value of the electronic document protected by the electronic digital signature

The electronic document for the purpose of ensuring protection of the electronic document can include one or several electronic digital signatures.

The electronic document protected by the electronic digital signature has the same legal value, as the document certified by the sign manual of person if authenticity of the electronic digital signature is confirmed and there are no sufficient evidences of the fact that the document is changed or counterfeited from the moment of its sending and (or) transfer for storage, except for those reversible changes which are necessary and inevitable by transfer and (or) storage of this electronic document. State bodies, local government bodies, physical persons and legal entities, the organizations shall not accept the electronic documents protected by the electronic digital signature if they have no appropriate technical means.

Article 5. Original of the electronic document

The original of the electronic document exists only on the electronic medium. All copies of the electronic document and its analogs registered on the electronic medium are considered as originals and have equal legal value.

If submission of the original of the electronic document is required, then this requirement is considered satisfied if:

a) it is possible to prove that the electronic document was not changed from the moment of its sending and (or) transfer for storage, except for those reversible changes which are necessary and inevitable during the sending and (or) storage of this electronic document;

b) representation of external form of an electronic document without informative changes to person which does not have special technical knowledge in form, clear and available to perception, is possible.

Article 6. Copies of the electronic document

1. Copies of the electronic document are created by representation of external form of an electronic document on paper, with assurance of their compliance to the original according to the procedure, established by the legislation.

2. Copies of the electronic document on paper shall contain mark that they are copies of the relevant electronic document.
