According to the Code of Ukraine about administrative offenses, the Laws of Ukraine "About militia", "About traffic" and "About measures of counteraction to drug trafficking, psychotropic substances and precursors and to abuse of them", the resolution of the Cabinet of Ministers of Ukraine of 17.12.2008 No. 1103 "About approval of the Procedure for the direction of transport drivers for carrying out survey for the purpose of identification of condition of alcoholic, drug or other intoxication or stay under the influence of the medicines reducing attention and reaction speed, and carrying out such survey" PRIKAZYVAYEM:
1. Approve the Instruction about identification at transport drivers of signs of alcoholic, drug or other intoxication or stay under the influence of the medicines reducing attention and reaction speed (further - the Instruction) which is applied.
2. To structural divisions and Ukrainian medical and monitoring center for alcohol and drugs of the Ministry of Health of Ukraine:
2.1. To provide to department of personnel policy, science and education development of appropriate programs and carrying out preparation and retraining of health workers which are involved in carrying out surveys for the purpose of identification of signs of alcoholic, drug or other intoxication or stay under the influence of the medicines reducing attention and reaction speed (further - state of intoxication).
2.2. To assign organizational and methodological providing concerning carrying out surveys for the purpose of identification of state of intoxication to the Ukrainian medical and monitoring center for alcohol and drugs of the Ministry of Health of Ukraine.
3. To the Minister of Health of the Autonomous Republic of Crimea, chiefs of managements of health care of regional public administrations, Headquarters of health care Kiev and Managements of health care Sevastopol city public administrations:
3.1. Take measures for expansion of network of institutions of health care which are granted the right of carrying out survey for the purpose of identification of condition of alcoholic, drug or other intoxication or concerning stay under the influence of the medicines reducing attention and reaction speed.
3.2. Provide the organization and control of carrying out by health workers of surveys of persons managing vehicles for the purpose of identification of state of intoxication according to requirements of this Instruction.
4. To provide to chiefs of headquarters, Departments of MIA of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol studying of this Instruction by staff of law-enforcement bodies which draws up materials about the administrative offenses made by persons managing vehicles concerning which there are enough bases to consider that they are in condition of alcoholic, drug or other intoxication or under the influence of the medicines reducing their attention and reaction speed.
