About state regulation of production and turnover of ethyl alcohol, alcoholic products, retail sale and consumption of alcoholic products, the toning soft and low alcohol drinks

This Law establishes the legal basis of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products, and also retail sale and consumption of alcoholic products, the toning soft and low alcohol drinks in the Kyrgyz Republic.

Article 1. Coverage of this Law

1. Operation of this Law extends to the relations which participants are legal entities, irrespective of legal forms and patterns of ownership, and also on the individual entrepreneurs performing activities for retail sale of alcoholic products.

2. Operation of this Law does not extend:

- on activities of the physical persons making products containing ethyl alcohol, not for the purpose of sale;

- on the organization activity connected with production and turnover of the medicinal, treatment-and-prophylactic, diagnostic funds containing ethyl alcohol, products of medical appointment and also for the activities of pharmaceutical institutions connected with production of means according to individual recipes including the homeopathic medicines, medicines of veterinary appointment, perfumery and cosmetic products performing the activities in the procedure established by the legislation of the Kyrgyz Republic, and also other industrial goods;

- on activities for production and turnover of natural drinks, except for beer, with content of ethyl alcohol no more than 6 percent of amount of finished goods made without addition of ethyl alcohol;

- on activities for production and turnover of alcohol-containing products, except for efiro-aldegidny fraction.

3. Purchase of ethyl alcohol for medical, veterinary and other purposes is performed according to the procedure, determined by the Government of the Kyrgyz Republic.

Article 2. The basic concepts used in this Law

In this Law the following concepts are used:

adsorbent - the substances which are well absorbing various components from liquids and gases;

alcoholic products - food products which are made with use of the ethyl alcohol produced from food raw materials, and (or) alcohol-containing food products with content of ethyl alcohol of more 1,5 of percent of amount of finished goods;

waterless alcohol - the absolute alcohol or absolute alcohol which is not containing water, used as the conditional concept applied in calculations;

the denatured ethyl alcohol - ethyl crude alcohol to which are added unpleasant smell or taste of substance, soluble in alcohol and not allocated from it by the elementary physical and chemical methods (distillation, vymorazhivaniye, filtering, etc.);

the foreign legal entity - the legal entity who has one of following signs:

- it is created and registered according to the legislation of foreign state;

- belongs completely to one or more foreign physical persons or legal entities;

- is controlled or operated by one or more foreign physical persons or legal entities by means of: the written contract, the right to exercise the majority of voting shares, the rights to appoint most of members of executive or supervisory body;

- it is registered in the Kyrgyz Republic and has at least 49 percent of the authorized capital belonging to the foreign citizens, stateless persons or legal entities mentioned in this concept;
