Appendix

to the Order of Customs Service of the Republic of Moldova No. of the 158th of May 20, 2009

Methodology of classification of grape must and wine materials

This methodology was developed based on the Explanations to the Harmonized commodity description and coding system developed by World Customs Organization, one of the parties of which is the Republic of Moldova, and additional notes 2 and 3 of group 22 "Alcoholic and soft drinks and vinegar" the Combined commodity nomenclature approved by the Law No. 172 of July 25, 2014.

In subsubline item 2204 30 100 "the grape must which is partially fermented..." means the product received by fermentation of grape must with the actual volume fraction of ethyl alcohol more than 1%, but less than three fifth of its general volume fraction.

The product of spirit fermentation of grape must (wine material) from shares of ethyl alcohol 3/5 of general volume concentration of alcohol is also more classified in goods item 2204 29.

Data on product (amount of alcohol, sugar...) are confirmed by passport details of quality or results of laboratory research of sample.

For the correct classification of goods it is necessary to use the following example:

1. Information on product following:

1.1 volume particle of ethyl alcohol - % 10,7

1.2 mass concentration of sugar - 3,07 of / 100 cm3

2. Calculation of concentration of alcohol in product:

2.1 the actual volume concentration of alcohol - 10,7 about %

2.2 potential volume concentration of alcohol about % is determined by multiplication of mass of sugar by coefficient of 0,6 3,07 x 0,6 # of 1,8 about %

2.3 general concentration of alcohol is equal to the amount of the actual volume concentration of alcohol and potential volume concentration of 10,7 alcohol @ to 12,5 1,8 # about %

2.4 three fifth general concentration of alcohol make 12, 5 x 3/5 # 7,5 about %

2.5 volume concentration of alcohol of this sample of 10,7 about % is more than 3/5 general concentration of 7,5 alcohol about %

Conclusion: wine material is classified in goods item 2204 29.

Please note that where in group 2204 distinction between products in vessels in reservoir 2 liters or less and in vessels in reservoir more than 2 l is carried out, it should be taken into account amount of the liquid containing in vessels, but not reservoir of vessels.
