1. 2. Declare invalid the order of the Minister of Foreign Affairs of the Republic of Kazakhstan of August 18, 2000 No. 115 "About approval of Rules of accreditation of Chapters, employees, military attaches and administrative technicians of diplomatic missions, consular establishments, representative offices of the international organizations and foreign investors in the Republic of Kazakhstan". 1. General provisions

This Instruction is developed according to provisions of the Vienna convention on the diplomatic intercourses of April 18, 1961, the Vienna convention on the consular intercourses of April 24, 1963, the international treaties ratified by the Republic of Kazakhstan and regulates order of registration of diplomatic representations, international organizations and/or their representations, consular establishments, accreditations of Chapters, members of personnel of diplomatic representations, international organizations and/or their representations, employees of consular establishments, military, sea and aviation attaches in the Republic of Kazakhstan.

2. For the purposes of this Instruction the international organization according to the subitem i) Item 1 of article 2 of the Vienna convention on the right of international treaties of May 23, 1969, the subitem 7) of article 1 of the Law of the Republic of Kazakhstan of May 30, 2005 "About international treaties of the Republic of Kazakhstan" is understood as only interstate or intergovernmental organization.

2. Registration of diplomatic representation, international organization and/or its representation, consular establishment under the Ministry of Foreign Affairs of the Republic of Kazakhstan

The basis for registration of diplomatic representation, the international organization and/or its representation, consular establishment is the note of Foreign Ministry of foreign state, the international organization or its representation about opening of diplomatic representation, international organization and/or its representation, consular establishment in the Republic of Kazakhstan.

4. After approval of competent state bodies of the Republic of Kazakhstan the Ministry of Foreign Affairs of the Republic of Kazakhstan (further - the Ministry of Foreign Affairs) sends to diplomatic representation, the international organization and/or its representation, consular establishment note about registration confirmation of diplomatic representation, international organization and/or its representation, consular establishment under the Ministry of Foreign Affairs to the address specified in note.

5. After receipt of the confirmation specified in item 4 of this Instruction, from the date of the first accreditation of the arrived member of personnel of diplomatic representation of the directing state, the employee of the international organization and/or its representation, the worker of consular personnel of consular establishment of the represented state the diplomatic representation, the international organization and/or its representation, consular establishment is considered registered under the Ministry of Foreign Affairs.

3. Accreditation of the Ambassador extraordinary and plenipotentiary and Nuncio

The basis for accreditation of the Ambassador extraordinary and plenipotentiary, the Nuncio (further - the Ambassador) directing the states is the note request of Foreign Ministry of the directing state in the Ministry of Foreign Affairs about issue of consent (agreement) with appendix of bio data of the candidate for position of the Ambassador.

7. After approval of competent state bodies of the Republic of Kazakhstan, the Ministry of Foreign Affairs directs to Foreign Ministry of the directing state consent or refusal to the presented candidacy.

Again appointed Ambassador with the residence in the Republic of Kazakhstan hands credential letters to the President of the Republic of Kazakhstan, and the Ambassador appointed in combination (with the residence in other state), - to the State secretary of the Republic of Kazakhstan. Counting of term of its stay in the Republic of Kazakhstan is conducted from the date of delivery of credential letters.

9. After delivery of credential letters to management of the Republic of Kazakhstan the Service of the State protocol of the Ministry of Foreign Affairs organizes meeting of the Ambassador with the Minister of Foreign Affairs of the Republic of Kazakhstan.

4. Accreditation of Chargês d'affaires

10. The basis for accreditation of the Chargê d'affaires is the note of Foreign Ministry of the directing state about appointment of the Chargê d'affaires.

11. From the date of delivery of the message of the Foreign Minister of the directing state about appointment of the Chargê d'affaires to the Deputy minister of foreign affairs of the Republic of Kazakhstan, the Chargê d'affaires is considered started accomplishment of the functions.
