ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

of September 19, 2009 No. 594

About approval of the Regulations on state regulation of import and export of ozone-depleting substances and products containing them

(as amended on 30-04-2020)

For the purpose of implementation of actions, indicators of the international rating of the Kyrgyz Republic directed to improvement according to the report of the World Bank "Business - 2010", the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Regulations on state regulation of import and export of ozone-depleting substances and products containing them.

2. Recognize to invalid:

- the order of the Government of the Kyrgyz Republic of September 6, 2000 No. 552 "About first-priority measures for accomplishment of the Vienna convention on protection of ozone layer and the Montreal protocol for the substances destroying ozone layer";

- Item 24 of the order of the Government of the Kyrgyz Republic of August 17, 2004 No. 622 "About modification and amendments in some decisions of the Government of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of November 25, 2004 No. 860 "About modification and amendments in the order of the Government of the Kyrgyz Republic of September 6, 2000 No. 552 "About first-priority measures for accomplishment of the Vienna convention on protection of ozone layer and the Montreal protocol for the substances destroying ozone layer".

3. This resolution becomes effective after 30 days from the date of official publication.

4. To impose control over the implementation of this resolution on department of agro-industrial complex and environmental management of Government office of the Kyrgyz Republic.

Regulations on state regulation of import and export of ozone-depleting substances and products containing them

1. This Provision is developed according to requirements of the Vienna convention on protection of ozone layer and the Montreal protocol for the substances destroying ozone layer (further - the Montreal protocol), and reflects questions of state regulation of import and export of ozone-depleting substances and containing them products specified in appendices No. 1 and 2 to this Provision.

2. The provision determines procedure for import and export of ozone-depleting substances and products containing them and extends to all legal entities and physical persons, irrespective of patterns of ownership, except as specified, stipulated by the legislation the Kyrgyz Republic and international treaties of the Kyrgyz Republic.

3. Licenses for import and export of the substances and products containing ozone-depleting substances specified in appendices 1 and 2 to this Provision are issued by the authorized state body of the executive authority performing functions on development and realization of state policy in the field of antimonopoly, tariff, licensed, investment, external economic, fiscal policy, policy in the field of the state material reserves, economic and regional development, management of state-owned property and mineral resources (subsurface use), technical regulation and metrology and also in the field of development of halalas industries, trade, development of entrepreneurship and optimization of the regulatory legal base of regulation of business activity, development of free economic zones, on the basis of the reference of authorized state body in the field of environmental protection.

Import and export of products in case of which operation ozone-depleting substances are used is forbidden. Availability of ozone-depleting substances in goods or provided by technical characteristics in case of its operation is determined on the basis of marking of goods and other accompanying documents.

Not allowed

- import to the Kyrgyz Republic from the territory of state member of the Eurasian Economic Union and (or) export from the Kyrgyz Republic on the territory of state member of the Eurasian Economic Union of ozone-depleting substances physical persons, except for individual entrepreneurs;

- import to the Kyrgyz Republic from the territory of state member of the Eurasian Economic Union of products containing ozone-depleting substances, except for import of such products by physical persons in goods quality for private use, and also other cases when the international legal act constituting the regulatory legal base of Eurasian economic space allows import of such products to customs area of the Eurasian Economic Union;

- import to the Kyrgyz Republic from the territory of state member of the Eurasian Economic Union of the ozone-depleting substances relating to prohibited for import, except for import of ozone-depleting substances in the particular cases of their application provided by the Montreal protocol on the substances destroying ozone layer, movements by transit through the territory of the Kyrgyz Republic of ozone-depleting substances between state members of the Eurasian Economic Union;

- import to the Kyrgyz Republic from the territory of state member of the Eurasian Economic Union of the ozone-depleting substances containing in the reservoirs which are not subject to repeated gas station since January 1, 2016.
