This Law determines the general legal, organizational and financial principles of functioning and development of the scientific and technical sphere of the CIS and is directed to creation of such conditions for scientific and scientific and technical activities in each of the State Parties which will allow to provide the needs for scientific and technical development of the certain states and the Commonwealth in general on the basis of consolidation of national scientific capacities and targeting them on the solution of first-priority economic, social and environmental problems of the CIS. The realization of provisions of this Law shall be enabled taking into account opportunities of broad exchange of scientific information and on the basis of accomplishment of joint research operations within the Commonwealth.
In this Law the following basic concepts and their determinations are applied:
scientific activities - the creative activities directed to receipt of new knowledge of the nature, society, the person and to use of this knowledge for search and updating of new methods of their application. Its main forms is basic and applied scientific research;
scientific and technical activities - the creative activities directed to obtaining and use of new knowledge in all industries of the equipment and technologies for the purpose of creation new or enhancements of the existing methods and policy tools of specific production and engineering procedures. Its main forms (types) are research, developmental, design, technological, search and design-search works, production of prototypes or batches of scientific and technical products, and also other works connected with bringing scientific and scientific and technical knowledge to stage of their practical use. Also works on scientific methodically, patent licensed, program, organizational methodically and to technical supply of direct carrying out research and development, and also on their distribution and use of results belong to scientific and technical activities;
basic scientific research - the scientific theoretical and (or) experimental activities directed to receipt of new knowledge of patterns of development of the nature, society, the person, their interrelation;
applied scientific research - the scientific and scientific and technical activities directed to obtaining and use of results of basic scientific research for achievement of the specific practical purposes;
subjects of scientific activities - physical and (or) legal entities, the associations of physical and (or) legal entities performing scientific activities;
participants of scientific activities - physical and (or) legal entities who act as customers or investors of scientific projects perform information, patent and licensed, metrological, program, organizational and methodical, technical supply of scientific activities;
the scientist - physical person (the citizen of the state, the foreigner or the stateless person) having academic degree and (or) the scientific rank which is performing professional scientific or scientific and technical activity for the purpose of carrying out scientific research and experienced and experimental developments, received the scientific and scientific and technical results recognized by scientific community in certain knowledge domain;
the scientist - the scientist who on principle place of employment and according to the employment contract (contract) professionally is engaged in scientific, scientific and technical or scientific and pedagogical activities, having the corresponding qualification confirmed with results of certification;
research establishment (scientific institution) the legal entity irrespective of pattern of ownership who is created in the procedure established by the legislation for which scientific or scientific and technical activities are the main and constitutes over 70% of general annual amount of completed work;
scientific work - research for the purpose of receipt of scientific result;
scientific result - the new knowledge received in the course of basic or applied scientific research and fixed on carriers of scientific information in report form, the scientific article, the scientific report, the scientific message on the carried-out research work, discovery, the published monograph;
the scientific and applied result - the new constructive or technology solution, experimental sample, the finished testing, development which is implemented or can be implemented in public practice. The scientific and applied result can be provided in report form, the outline sketch, design or technological documentation on scientific and technical products, natural sample.
Legal regulation of the relations in the field of scientific and scientific and technical activities is based on constitutions of the State Parties of the CIS, provisions of this Law, international treaties and agreements in scientific and technical area.
Determination belongs to the main objectives of this Law:
- legal status of subjects of scientific and scientific and technical activities, material and moral incentives of ensuring prestigiousness and the priority of this sphere of human activities, attraction predetermined by public requirements in it intellectual potential of the nation;
- economic, social and legal guarantees of scientific and scientific and technical activities, freedom of scientific creativity;
- main objectives, the directions and the principles of state policy of the State Parties of the CIS taking into account opportunities of creation of legal conditions of forming of the approved approaches to joint scientific and scientific and technical activities;
- reconciliation procedures of the principles and mechanisms of interstate regulation and management in the field of scientific and scientific and technical activities;
- powers of public authorities concerning implementation of the state regulation and management in the field of scientific and scientific and technical activities.
Scientific and scientific and technical activities can carry both individual, and collective nature.
Subjects of individual scientific and scientific and technical activities are physical persons.
Can be subjects of collective scientific and scientific and technical activities:
- temporary research teams;
- scientific organizations;
- the organizations providing the higher and postgraduate education, advanced training and retraining of personnel.
