Approve Regulations on the state forest protection, forest protection of other permanent forest users and owners of the woods which is applied.

Regulations on the state forest protection, forest protection of other permanent forest users and owners of the woods

1. The state forest protection (further - goslesokhrana) is effective in structure Derzhlisagentstva, Republican committee of the Autonomous Republic of Crimea concerning forest and hunting economy, regional managements of forest and hunting economy and the companies, organizations and the organizations which treat the management sphere Derzhlisagentstva.

Goslesokhrana has the status of law enforcement agency.

Forest protection of other permanent forest users and owners of the woods is effective as a part of the companies, organizations, the organizations which do not treat the management sphere Goslesagentstva, and in permanent use or property of which there are woods.

2. The purpose of activities of goslesokhrana, forest protection of other permanent forest users and owners of the woods is implementation of the legal lesookhranny and other actions directed to preserving expanded reproduction, not wearisome use of forest resources, and fauna objects.

3. In the activities the goslesokhrana, forest protection of other permanent forest users and owners of the woods is guided by the Constitution and the laws of Ukraine, and also the presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, this Provision and other regulatory legal acts.

4. The main tasks of goslesokhrana is:

implementation of the state control of observance of requirements of the forest and hunting legislation;

ensuring forest conservation from the fires, illegal cabins, wreckers and diseases, damage to result of anthropogenous and other adverse effect;

prevention of crimes and administrative offenses in the field of forest and hunting economy, and also use of forest resources and hunting animals;

organization and coordination of actions for protection state hunting fund.

4-1. The main objectives of forest protection of other forest users and owners of the woods are the tasks determined by paragraphs 3 - 5 of item 4 of this provision.

5. Officials Derzhlisagentstva, Republican committee of the Autonomous Republic of Crimea concerning forest and hunting economy, regional managements of forest and hunting economy and the companies, organizations and the organizations which treat the management sphere Derzhlisagentstva, according to appendix treat officials of goslesokhrana.

Officials of the companies, organizations, the organizations which are not relating to the management sphere Goslesagentstva treat officials of forest protection of other permanent forest users and owners of the woods and in permanent use or property of which there are woods, according to appendix.

6. Goslesokhrana, forest protection of other permanent forest users and owners of the woods during organization of events directed to elimination of violations of the forest legislation and legislation in industries of hunting economy and hunting interacts with law enforcement agencies, central and local executive bodies, local government bodies, citizens and their associations.

7. Officials of goslesokhrana, forest protection of other permanent forest users and owners of the woods according to the tasks assigned to them have the right:

to inspect freely in the procedure for the wood established by the legislation which are in property or use of citizens and legal entities;

check in accordance with the established procedure at citizens and legal entities availability of permissions and other documents for use of forest resources and use of the woods and for the right of hunting and use of resources of the state hunting fund;

Perform observance by forest users, owners of the woods and users of hunting grounds of requirements of regulatory legal acts and regulating documents concerning forest management and in the field of hunting economy and hunting;

constitute protocols and consider according to the legislation cases on administrative offenses, offenses in the field of protection, protection, use and reproduction of the woods, and also in the field of hunting economy and hunting;

stop vehicles in the territory of forest fund and perform inspection of vehicles, the tools got wood and other products of the wood and also to stop transport (floating) means in the territory of hunting grounds and to perform their inspection and survey of tools of hunting, the got products;

store, carry and use special means and weapon according to the procedure, established by the legislation and to use special vehicles with tsvetografichesky coloring, text and emblem;

bring person who violated the forest law or the legislation in the field of hunting economy and hunting, in bodies of National police or in local government bodies in case of impossibility of establishment of his identity on site of making of offense for creation of the protocol on administrative offense;

withdraw in the procedure established by the law from citizens and legal entities who violated the forest law or the legislation in the field of hunting economy and hunting, documents for right to use of forest resources and on the hunting right, the extracted wood and other products of the wood, the hunting animals illegally got and products that from them it is made, and tools of crimes;

send to the relevant state bodies materials about involvement of persons who violated the forest law or the legislation in the field of hunting economy and hunting to disciplinary, administrative and criminal liability;

carry out in the cases established by the law, photography, sound recording, film and video filming as supportive application for prevention to violations in the field of protection, protection, use and reproduction of the woods, and also in the field of hunting economy and hunting;

call citizens, including officials, for obtaining from them oral or written explanations in connection with violation of the forest legislation or the legislation by them in industry of hunting economy and hunting;

to freely visit the territory and rooms of legal entities which perform the activities connected with production, storage or conversion of wood and other products of the wood for the purpose of implementation of supervision of legality of their use;
