About realization of wood which is received when using the woods located on lands of forest fund according to Articles 43 - 46 Forests codes of the Russian Federation

1. Approve the enclosed Rules of realization of wood which is received when using the woods located on lands of forest fund according to Articles 43 - 46 Forests codes of the Russian Federation.

2. Determine that the federal executive body authorized on realization of wood which is received when using the woods located on lands of forest fund according to Articles 43 - 46 Forests codes of the Russian Federation is the Federal Agency for State Property Management.

3. The Federal Agency for State Property Management performs functions on realization of the wood specified in Item 2 of this resolution within the established extreme number of employees of its central office and territorial authorities, and also budgetary appropriations provided to the Agency in the federal budget on management and management in the field of the established functions.

Rules of realization of wood which is received when using the woods located on lands of forest fund according to Articles 43 - 46 Forests codes of the Russian Federation

1. These rules establish procedure for realization of wood which is received when using the woods located on lands of forest fund according to Articles 43 - 46 Forests codes of the Russian Federation for the purpose of:

a) performance of works on geological studying of subsoil, developments of mineral deposits;

b) construction and operation of water storage basins and other artificial water objects, and also hydraulic engineering constructions and specialized ports;

c) constructions, reconstruction, operation of power lines, communication lines, roads, pipelines and other linear objects;

d) conversions of wood and other forest resources.

2. Wood in these rules is understood as the raw round wood.

3. When using of the woods by legal entities and physical persons for the purposes specified in Item 1 of these rules, the cabin of forest plantings is performed according to the project of development of the woods (in the cases provided by the Forest code of the Russian Federation), rules of sanitary safety in the woods and fire safety regulations in the woods.

4. These rules do not extend to persons who signed the lease agreement of the wood lot for procurement of wood according to the Forest code of the Russian Federation.

5. Federal Agency for State Property Management (further - the seller):

a) establishes the commitment form on acquisition of wood (daleezayavka) and term of acceptance of the request;

b) performs placement of the message on wood realization (further - the message) on the official site of the seller on the Internet and on the official site of the Russian Federation determined by the Government of the Russian Federation on the Internet for placement of information on tendering (further - placement);

c) considers requests of legal entities and physical persons (daleezayavitel);

d) performs registration of the request in the magazine of order taking with indication of date and time of their receipt;

e) signs purchase and sale agreements of wood;

e) performs preparation and placement of the message on wood realization results.

6. The location of wood is the wood lot provided to person using the woods for the purposes specified in Item 1 of these rules. At the same time movement of wood is allowed in coordination with the seller.

7. In case of refusal from obtaining or absence at the scheduled time of consent to voluntary conveyance of wood or in case of wood non receipt by the Ministry of Defence of the Russian Federation at the scheduled time according to Rules of the order of the Russian Federation which is in property wood which is received during construction of reconstruction, operation of linear objects, approved by the order of the Government of the Russian Federation of December 14, 2023 No. 2153 "About approval of Rules of the order of the Russian Federation which is in property wood which is received during construction, of reconstruction, operation of linear objects", the legal entities and physical persons using the woods for the purposes specified in Item 1 of these rules send information on amounts and on pedigree composition of the cut-down wood no later than 1 working day from the date of approach of the corresponding event to public authority of the subject of the Russian Federation, and if the wood lot is located on lands of forest fund concerning which implementation of the powers provided by part 1 of Article 83 of the Forest code of the Russian Federation is not contributed to public authorities of the subject of the Russian Federation according to part 2 of Article 83 of the Forest code of the Russian Federation, - in territorial authority of Federal Forestry Agency (further - authorized body of the executive authority in the field of the forest relations).

8. The authorized body of the executive authority in the field of the forest relations within 5 working days from the date of receipt of information specified in Item 7 of these rules sends to the seller the following information about persons using the woods for the purposes specified in Item 1 of these rules, and the wood lot:

a) the name of the legal entity, surname, name, middle name - for physical person;

b) details of lease agreements of the timberland and free use or the decision on provision of the timberland on the right of permanent (termless) use and limited use of others timberland (servitude);

c) the location information of the wood lot according to materials of forest management and its cadastral number (in the presence);

d) data on amount, pedigree structure and cost of wood which is received when using the woods for the purposes specified in Item 1 of these rules. At the same time the cost of wood is calculated proceeding from rates of payment for unit of volume of wood of the forest plantings established by the order of the Government of the Russian Federation of May 22, 2007 No. 310;

e) date of completion of the cabin of forest plantings.

9. The seller performs placement of the message within 5 working days from the date of receipt of the data specified in Item 8 of these rules.
