Standard technology of interaction of customs authorities and railway administrations of the State Parties of the CIS in case of the customs clearance and goods control moved with railway transport

1. General provisions

1.1. This document (further "Standard technology") determines technology of customs clearance and the goods control moved through customs border of the State Party of the CIS by rail with car sendings (including routes), small sendings, in containers.

Action of this "Standard technology" does not extend to the military loads and goods transported by special communication cars.

1.2. The goods moved through customs border of gosudarstvauchastnik of the CIS by rail are subject to customs clearance and customs control according to the procedure, provided by the national customs legislation of the State Party of the CIS and this "Standard technology" which determines features of customs clearance of the goods transported by railway transport.

1.3. The customs clearance and goods control, are made in the terms established for such registration and control by the customs legislation of the State Party of the CIS.

1.4. In case of change of procedure for customs clearance the state customs authorities and railway administration jointly develop and announce in accordance with the established procedure amendments and changes to this technology.

1.5. In this technology the basic concepts in the following values are used:

- the border railway station - the check point of goods and vehicles through frontier of gosudarstvauchastnik of the CIS;

- goods - the loads, baggage and cargo baggage moved through customs border of the State Party of the CIS by rail;

- the vehicle - the means used for transportation of goods including: cars and containers;

- carriage documents - the rail waybill, the road sheet;

- sending - the goods accepted for shipment from one sender on one delivery note on one station of origin to one receiver on one station of destination;

- ZPU - the locking and sealing devices intended for blocking and sealing of doors and hatches of cars and containers;

- places public - the covered and ground storages, and also the sites which are specially allocated for the territories of the railway station belonging to the railroad and used for accomplishment of transactions on loading, unloading, sorting, storage of goods;

- places of uncommon use - the covered and ground storages, and also the sites belonging to the companies and the organizations used for accomplishment of transactions on loading, unloading, sorting, storage of goods;

- the customs control zone - specially allocated designated place intended for goods and vehicles, and also carrying out with them cargo and other operations under customs control.

2. Conditions of transportations of goods under customs control

2.1. Transportation of goods concerning which the customs clearance is not complete from customs authority of departure to customs authority of appointment is performed under customs control.

The decisions of officials of customs authorities made within the customs legislation concerning the goods transported under customs control are obligatory for workers of the railroads.

2.2. Goods under customs control are transported by the railroads according to current agreements on transportation of goods in the international message by the railroads of the State Party of the CIS (further - agreements), the regulation of the national legal system (Rules of transportation of goods) of the State Party of the CIS, with observance of the customs legislation of the State Party of the CIS and this Technology.

2.3. The customs authority of departure establishes delivery date of goods to customs authority of appointment according to normative terms of transportation.

2.4. The railroads shall deliver goods without any change of packaging or condition, except changes owing to natural wear or transportations and storages on station of destination decreased under normal conditions and to notify customs authority in which region of activities there is the specified station on the goods delivery, having submitted on them covering notes and carriage documents.

2.5. Workers of the railroads have no right to issue the goods transported under customs control without the permission of customs authorities.

2.6. When transporting goods under customs control by the railroads providing customs payment is not required if other is not provided by the national legal system.

3. Procedure for customs clearance in case of cargo importation on customs area of the states

3.1. The customs clearance and customs control of goods by officials of customs authority begins with acceptance from workers of the border station of the notification on crossing of customs border in case of commodity importation and vehicles on customs area of the State Party of the CIS. Workers of the border station shall notify officials of customs authority on arrival of goods from abroad by submission of documents (the transfer sheet, carriage and shipping documents), according to the national legal system of the State Party of the CIS.
