ORDER OF THE MINISTRY OF QUESTIONS OF HOUSING AND COMMUNAL SERVICES OF UKRAINE

of July 24, 2009 No. 223

About approval of Rules of accession of cogeneration installations to thermal networks

In pursuance of article 12 of the Law of Ukraine "About the combined production of heat and electrical energy (cogeneration) and use of waste power potential" I order:

1. Approve Rules of accession of cogeneration installations to thermal networks which are attached.

2. To department of state regulation (Berezovskaya K. V.) and to Legal management (Krylova I. I.) submit the order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. To impose control over the implementation of this order on the deputy minister Gavrilyuk O. V.

4. The order becomes effective from the date of its official publication.

Praivla of accession of cogeneration installations to thermal networks

1. General provisions

1.1. Rules of accession of cogeneration installations to thermal networks (further - Rules) govern the relations arising between the heattransporting organizations and customers in case of the accession and connection which are new constructed, reconstructed or the modernized cogeneration installations of customers to thermal networks.

1.2. For Rules terms and determinations are used in such value:

the act of the technical commission of readiness of cogeneration installation for acceptance in operation - the document confirming readiness of cogeneration installation for operation;

basic data for designing - the list of reasonable technical requirements of rather engineering support of construction object or reconstruction or upgrade;

the admission on connection of cogeneration installation - complex of the actions necessary for ensuring safe and accident-free operation of the thermal networks directed to prevention of cases of abuse of regulations;

the Treaty of Accession - the written agreement governing the relations between the customer and the heattransporting organization in the course of obtaining and accomplishment of specifications of accession of system of heatconsumption of the customer to thermal networks;

the customer - the owner of cogeneration installation who wishes to attach to thermal networks new constructed (established or constructed based on the existing energy object), the reconstructed or modernized cogeneration installation;

operating-technical servicing - round-the-clock technical, with observance of safety requirements operation of sources of heat supply with providing reliable and uninterrupted supply of heat energy;

accession of cogeneration installation - provision to the customer the heattransporting organization of service in creation of technical capability of implementation of transportation in point of accession to thermal networks of necessary amount of the corresponding capacity of heat energy;

specifications of accession of cogeneration installation to thermal network - the document which is issued to the customer by the heattransporting organization and contains basic data for designing (further - specifications);

point of accession of cogeneration installation - the designed or actually existing border of balance sheet accessory.

Other terms and determinations are used in these Rules in the value established by the Laws of Ukraine "About heat supply" "About the combined production of heat and electrical energy (cogeneration) and use of waste power potential", the Rules of technical operation of thermal installations and networks approved by the order of the Ministry of Fuel and Energy of Ukraine of 14.02.2007 of N 71, registered in Ministry of Justice of 05.03.2007 for N 197/13464.

1.3. Accession of cogeneration installation of the customer is performed by the heattransporting organization based on the Treaty of Accession which consists between the heattransporting organization and the customer whose integral appendix are specifications on accession (appendix 1).

1.4. The owner of thermal network shall connect cogeneration installation to the thermal network according to the procedure, established by normative and technical acts, on condition of agreement performance on accession and after approval of the act of the technical commission of readiness of cogeneration installation for acceptance for operation.

1.5. If within the territory in which cogeneration installation is located or the construction of new cogeneration installation of the customer is provided, there is possibility of accession to thermal networks which belong to the different owners (heatdelivering and the heattransporting organizations), then the optimum point of accession of cogeneration installation is determined by the choice of the customer according to technical parameters of this cogeneration installation (capacity, pressure and so forth).

1.6. Accession of cogeneration installation of the customer to thermal network provides such stages:

determination by the customer of the project organization which will develop on contractual conditions with the customer the corresponding project documentation;

giving by the customer of the heattransporting organization of the statement of accession of its cogeneration installation to thermal network;

preparation by the heattransporting project organization of the Treaty of Accession and specifications of accession;

issue to the project orderer of the Treaty of Accession and specifications of accession;

development and approval by agreement parties about accession of the scheme of accession of cogeneration installation to thermal network;

signing by agreement parties about accession;

development by the customer (in the absence of such the vozmozhnostiproyektny organization on contractual conditions with the customer) the project documentation for construction objects and reconstruction or upgrade and its approval of the heattransporting organization (the organization which issued specifications);

payment by the customer of the heattransporting organization of cost of accession in accordance with the terms of the Treaty of Accession;

construction and mounting and adjustment works according to the coordinated project documentation;

carrying out acceptance testing;

receipt of the act of the technical commission of readiness of cogeneration installation for acceptance in operation;

connection of cogeneration installation of the customer to thermal network.
