About physical culture and sport

This Law establishes organization-legal, social and economic bases of activities and the basic principles of state policy in the field of physical culture and sport in the Azerbaijan Republic, governs the relations arising in this sphere, guarantees the right of everyone to play physical culture and sport.

Chapter I. General provisions

Article 1. Basic concepts

1.0. The basic concepts used in this Law have the following values:

1.0.1. physical culture - the integral part of general culture of society representing the sphere of the social activities reflecting in itself set of the values, regulations and knowledge directed to forming of healthy lifestyle of the person by means of physical exercises, its physical and intellectual development;

1.0.2. sport - the component of physical culture directed to continuous improvement of physical training of person by means of complex of different physical exercises, its participation in competitions of all levels and achievement of good results;

1.0.3. mass sport - the part of sport directed to organized occupation of the population by physical culture and physical development, and also its participation in sports and improving actions and mass sports competitions;

1.0.4. physical training - the process aimed at the development of physical qualities, capabilities of the person taking into account type of its activities and social and demographic characteristics;

1.0.5. physical perfection - process of harmonious combination of physical and moral qualities in each person playing physical culture and sport;

1.0.6. the athlete - the physical person which is constantly doing chosen as type or sports and competing at sports competitions;

1.0.7. the high-class athlete - the athlete having the corresponding sports rank (category) and competing at sports competitions for the purpose of achievement of high sports results;

1.0.8. professional sport - the part of sport directed to the organization and holding sports and spectacular actions (competitions) in which and preparation for which as the professional (labor) activity athletes receive for participation according to the legislation the salary (monetary reward);

1.0.9. the trainer - the physical person having the corresponding higher or secondary professional education and performing carrying out with athletes of educational and training process, management of their competitive activities for achievement of good results;

1.0.10. the sports judge - the physical person authorized by the organizer of sports competition to exercise control over observance of rules of sport and regulations (regulations) on competition, had special training and received the corresponding qualification category;

1.0.11. sport - the part of sport having the following distinctive signs: the circle of occupations, the used sports equipment (without protective equipment) and the equipment, acceptance in accordance with the established procedure rules of competition;

1.0.12. sports discipline - the part of sport having distinctive signs;

1.0.13. military and applied and office and applied sports, sports which basis are the special actions (including acceptances) connected with accomplishment by the military personnel and staff of some law enforcement agencies (further - persons passing special service) the service duties, and which develop within activities of one or several military or law enforcement agencies;

1.0.14. national sports - the sports which historically developed in ethnic groups of the population and having welfare focus;

1.0.15. republican sports federation - the public association which is created on the basis of membership obtained the state accreditation and which purposes are development of one or several sports, and also holding sporting events of republican or international scale, forming of the national teams of teams, preparation and their participation in the international competitions;

1.0.16. the national teams of team - the groups of the athletes belonging to different age groupes, trainers and other specialists in the field of physical culture and sport for preparation for the international sports competitions and representation at these competitions of the state created by republican sports federations on different types of sport and approved by relevant organ of the executive authority;

1.0.17. official sports and sporting events - actions and competitions of district, city, republican and international scale included in schedules of sports and improving and sporting events;

1.0.18. the organizer of sports and sporting events - legal or physical entity - the initiator who undertakes the solution of questions of organization of events and sports competitions, other questions connected with their financing, preparation and carrying out;

1.0.19. system of physical culture and sport - the activities of state bodies and municipalities, non-governmental organizations, physical persons and legal entities performed in interaction for the purpose of development of physical culture and sport;

1.0.20. monitoring of physical training and development of the population - assessment and forecasting of physical health, physical training and working capacity of the population, and also establishment of causes and effect relationships between them and physical development of the population;

1.0.21. physical rehabilitation - recovery of the broken or temporarily lost functions of human body and capabilities to public and professional activity of persons with disability with use of funds and methods of adaptive physical culture and adaptive sport which are allocated for elimination or perhaps more total compensation of the restrictions of life activity caused by violation of health;

1.0.22. the sport objects - constructed, the established sports constructions closed and are more open the objects which are specially intended for holding sports and sporting events (including educational and training process, sports competitions);

1.0.23. elite sport - the part of sport directed to demonstration and achievement of good results by athletes at official republican and international competitions;

1.0.24. Paralympic movement - the activities covering development of Paralympic sport as one of fixed assets of integration into society of persons with disability, their self-affirmation, achievement of physical and spiritual perfection by them;

1.0.25. deflimpiysky movement - the activities organized and performed on development of physical culture and sport between persons having limited opportunities of hearing;

1.0.26. the special Olympic Movement - the activities aimed at providing rehabilitation and integration into society of persons with limited opportunities of health by means of physical culture and sport;

1.0.27. sports totalizator - games which are held by the operator of sports totalizator on the basis of forecasting of the sports scores which are carried out in real time or other competitions (gallop chance games, runnings of borzois and so forth) held in real time, established by the rules of the organization and carrying out sports totalizator established by body (structure) or events in these competitions and bring to the participants who correctly guessed probability monetary rewards (prize) on the basis of in advance announced criteria. The lotteries established by the Law of the Azerbaijan Republic "About lotteries" are not considered as sports totalizator;

1.0.28. the operator of sports totalizators - the legal entity, the stipulated in Article 53-1 this Law, for the purpose of implementation of sports totalizators;

1.0.29. sports competitions - the sporting events of district, city, regional, republican and international scale accepted by the international or other authorized sports organizations;

1.0.30. manipulation with sports competitions - intentional act (action or failure to act) of person directed to change of the course or sports score for receipt of illegal benefit in own advantage or advantage of other person;

1.0.31. the virtual circle - the telecommunication networks, information systems and networks, information and telecommunication networks created by the operator of sports totalizators or the virtual seller for carrying out sports gamblings including the Internet, networks of mobile communication, social media platforms, other means of electronic communication, Internet and mobile telecommunication applications and platforms based on other technologies, operating under the trademark of the operator of sports totalizators and connected with the central system of rates of the operator of sports totalizators;

1.0.32. the seller of sports totalizator - the seller in the real circle and the virtual seller of sports totalizator;

1.0.33. the seller of sports totalizator in the real circle - person who on the basis of the agreement signed with the operator of sports totalizator (except as specified when the operator of sports totalizator is seller of sports totalizator), only with use of the trademark of the operator of sports totalizator performs sale of the sports gamblings organized by it and provides all transactions between participants of sports gambling and the operator of sports totalizator through the central system of rates by means of stationary and (or) mobile terminals;

1.0.34. the virtual seller - the legal entity who on the basis of the agreement signed with the operator of sports totalizator only with use of the trademark of the operator of sports totalizator performs sale of the sports gamblings organized by it and provides all communication between participants of sports gambling and the operator of sports totalizator through the central system of rates by means of the virtual circle.

Article 2. Legislation of the Azerbaijan Republic on physical culture and sport

The legislation of the Azerbaijan Republic on physical culture and sport consists of the Constitution of the Azerbaijan Republic, this Law, the Law of the Azerbaijan Republic "About fight against use of doping means and methods in sport" other regulatory legal acts and international treaties which participant is the Azerbaijan Republic.

Article 3. The basic principles of state policy in the field of physical culture and sport

3.0. The basic principles of state policy in the field of physical culture and sport are:

3.0.1. creation and enhancement of management system sports movement;

3.0.2. providing rights of citizens to occupation with physical culture and sport and creation for this purpose equal opportunities and conditions;

3.0.3. respect and observance of the international obligations by the state in the field of physical culture and sport;

3.0.4. importance of development of physical culture and sport among the needy and needing social protection segments of the population (children from large families, persons with disability);

3.0.5. interaction in the field of physical culture and sport of state bodies and municipalities, public associations of sports orientation;
