The parties perform cooperation in the organization of regular international direct railway ferry connection through ports Caucasus (Russia) and the Crimea (Ukraine).
For the purpose of ensuring operational management with the international direct railway ferry connection through ports Caucasus (Russia) and the Crimea (Ukraine) the Parties create the Council for joint operation of railway ferry crossing between ports Caucasus (Russia) and the Crimea (Ukraine) (further - Council) consisting on a parity basis of agents of the parties, the organizations of rail transport, maritime port authorities, owners of railway ferry boats of the states of the Parties.
The operating procedure of Council will be determined by Regulations on Council which affirm the separate arrangement between the Parties.
Transportation of goods by ferry vessels is performed according to Rules of transportation of goods in the international direct railway ferry connection through ports Caucasus (Russia) and the Crimea (Ukraine) which affirm the Parties.
The delivery note provided by the Agreement on the international railway freight traffic of November 1, 1951 is applied to transportation of goods in the international direct railway ferry connection through ports Caucasus (Russia) and the Crimea (Ukraine).
The parties provide immediate informing each other on emergence of obstacles for implementation of the international direct railway ferry connection through ports Caucasus (Russia) and the Crimea (Ukraine) in the territories of the states and take if necessary collateral actions for the purpose of elimination of these obstacles.
The parties promote carrying out the approved tariff policy directed to effective implementation of the international direct railway ferry connection through ports Caucasus (Russia) and the Crimea (Ukraine).
Any dispute on interpretation or application of provisions of this agreement is solved by negotiations between the Parties.
Modification and amendments in this agreement is drawn up by additional protocols.
This agreement is signed sine die and becomes effective in day of its signing.
This agreement will remain in force before the expiration of six months after any Party in writing notifies other Party on the intention to stop its action.
It is made in Kerch on November 12, 2004 in duplicate, everyone in the Russian and Ukrainian languages, and both texts are equally authoritative.
